| 7 | 7 | | relating to the operations of the office of independent ombudsman |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 64.054, Human Resources Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | Sec. 64.054. SUNSET PROVISION. The office is subject to |
|---|
| 13 | 13 | | review under Chapter 325, Government Code (Texas Sunset Act), but |
|---|
| 14 | 14 | | is not abolished under that chapter. The office shall be reviewed |
|---|
| 15 | 15 | | during the periods in which state agencies abolished in 2015 [2009] |
|---|
| 16 | 16 | | and every 12th year after 2015 [2009] are reviewed. |

| 17 | 17 | | SECTION 2. Subchapter B, Chapter 64, Human Resources Code, |
|---|
| 18 | 18 | | is amended by adding Section 64.060 to read as follows: |
|---|
| 19 | 19 | | Sec. 64.060. COMPLAINTS. (a) The office shall maintain a |
|---|
| 20 | 20 | | system to promptly and efficiently act on complaints filed with the |
|---|
| 21 | 21 | | office that relate to the operations or staff of the office. The |
|---|
| 22 | 22 | | office shall maintain information about parties to the complaint, |
|---|
| 23 | 23 | | the subject matter of the complaint, a summary of the results of the |
|---|
| 24 | 24 | | review or investigation of the complaint, and its disposition. |
|---|
| 25 | 25 | | (b) The office shall make information available describing |
|---|
| 26 | 26 | | its procedures for complaint investigation and resolution. |
|---|
| 27 | 27 | | (c) The office shall periodically notify the complaint |
|---|
| 28 | 28 | | parties of the status of the complaint until final disposition. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2009. |
