11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 363.006, Health and Safety Code, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | Sec. 363.006. CONSTRUCTION OF CHAPTER; EXEMPTIONS. (a) | |
15 | 15 | This chapter does not prohibit or limit a person from extracting or | |
16 | 16 | using solid waste [materials] that the person generates or legally | |
17 | 17 | collects or acquires for resource recovery [recycling] or resale. | |
18 | 18 | (b) Solid waste [Materials] that is [are] separated or | |
19 | 19 | recovered [from solid waste] for reuse, resource recovery, or | |
20 | 20 | processing [recycling] by the generator, by a private person under | |
21 | 21 | contract with the generator, or by a collector of solid waste for | |
22 | 22 | resource recovery is [or recovered materials are] not subject to | |
23 | 23 | this chapter. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2009. |
