A BILL TO BE ENTITLED
AN ACT
relating to an exemption from the applicability of the
Comprehensive Municipal Solid Waste Management, Resource Recovery,
and Conservation Act for certain solid waste used for resource
recovery or processing.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 363.006, Health and Safety Code, is
amended to read as follows:
Sec. 363.006. CONSTRUCTION OF CHAPTER; EXEMPTIONS. (a)
This chapter does not prohibit or limit a person from extracting or
using solid waste [materials] that the person generates or legally
collects or acquires for resource recovery [recycling] or resale.
(b) Solid waste [Materials] that is [are] separated or
recovered [from solid waste] for reuse, resource recovery, or
processing [recycling] by the generator, by a private person under
contract with the generator, or by a collector of solid waste for
resource recovery is [or recovered materials are] not subject to
this chapter.
SECTION 2. This Act takes effect September 1, 2009.
