5	5	relating to criminal history checks for employees of, and
6	6	applicants for employment at, special care facilities.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. The heading to Chapter 250, Health and Safety
9	9	Code, is amended to read as follows:
10	10	CHAPTER 250. NURSE AIDE REGISTRY AND CRIMINAL HISTORY CHECKS OF
11	11	EMPLOYEES AND APPLICANTS FOR EMPLOYMENT IN CERTAIN FACILITIES
12	12	SERVING THE ELDERLY, [OR] PERSONS WITH DISABILITIES, OR PERSONS
13	13	WITH TERMINAL ILLNESSES
14	14	SECTION 2. Section 250.001(3), Health and Safety Code, is
15	15	amended to read as follows:
16	16	(3) "Facility" means:
17	17	(A) a nursing home, custodial care home, or other
18	18	institution licensed by the [Texas] Department of Aging and
19	19	Disability [Human] Services under Chapter 242;
20	20	(B) an assisted living facility licensed by the
21	21	[Texas] Department of Aging and Disability [Human] Services under
22	22	Chapter 247;
23	23	(C) a home and community support services agency
24	24	licensed under Chapter 142;
25	25	(D) an adult day care facility licensed by the
26	26	[Texas] Department of Aging and Disability [Human] Services under
27	27	Chapter 103, Human Resources Code;
28	28	(E) a facility for persons with mental
29	29	retardation licensed under Chapter 252;
30	30	(F) an adult foster care provider that contracts
31	31	with the [Texas] Department of Aging and Disability [Human]
32	32	Services;
33	33	(G) a facility that provides mental health
34	34	services and that is operated by or contracts with the [Texas]
35	35	Department of State [Mental] Health Services [and Mental
36	36	Retardation];
37	37	(H) a local mental health or mental retardation
38	38	authority designated under Section 533.035; [or]
39	39	(I) a person exempt from licensing under Section
40	40	142.003(a)(19); or
41	41	(J) a special care facility licensed by the
42	42	Department of State Health Services under Chapter 248.
43	43	SECTION 3. This Act takes effect September 1, 2009.

50	50	conference committee to consider the differences between the two
51	51	houses; and that the House adopted the conference committee report
52	52	on H.B. No. 3737 on May 31, 2009, by the following vote: Yeas 142,
53	53	Nays 0, 1 present, not voting.
