55 relating to the use of hazardous and solid waste remediation fee
66 funds for lead-acid battery recycling activities.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 361.133(c), Health and Safety Code, is
99 amended to read as follows:
1010 (c) The commission may use the money collected and deposited
1111 to the credit of the account under this section, including interest
1212 credited under Subsection (b)(4), only for:
1313 (1) necessary and appropriate removal and remedial
1414 action at sites at which solid waste or hazardous substances have
1515 been disposed if funds from a liable person, independent third
1616 person, or the federal government are not sufficient for the
1717 removal or remedial action;
1818 (2) necessary and appropriate maintenance of removal
1919 and remedial actions for the expected life of those actions if:
2020 (A) funds from a liable person have been
2121 collected and deposited to the credit of the account for that
2222 purpose; or
2323 (B) funds from a liable person, independent third
2424 person, or the federal government are not sufficient for the
2525 maintenance;
2626 (3) expenses concerning compliance with:
2727 (A) the Comprehensive Environmental Response,
2828 Compensation and Liability Act of 1980 (42 U.S.C. Section 9601 et
2929 seq.) as amended;
3030 (B) the federal Superfund Amendments and
3131 Reauthorization Act of 1986 (10 U.S.C. Section 2701 et seq.); and
3232 (C) Subchapters F and I;
3333 (4) expenses concerning the regulation and management
3434 of household hazardous substances and the prevention of pollution
3535 of the water resources of the state from the uncontrolled release of
3636 hazardous substances;
3737 (5) expenses concerning the cleanup or removal of a
3838 spill, release, or potential threat of release of a hazardous
3939 substance where immediate action is appropriate to protect human
4040 health and the environment; [and]
4141 (6) expenses concerning implementation of the
4242 voluntary cleanup program under Subchapter S or federal brownfields
4343 initiatives; and
4444 (7) expenses, not to exceed 10 percent of the annually
4545 appropriated amount of the fees on batteries collected under
4646 Section 361.138, related to lead-acid battery recycling
4747 activities, including expenses for programs:
4848 (A) for remediation; and
4949 (B) to create incentives for the adoption of
5050 innovative technology in lead-acid battery recycling to increase
5151 the efficiency and effectiveness of the recycling process or reduce
5252 the negative environmental impacts of the recycling process.
5353 SECTION 2. This Act takes effect September 1, 2009.
