1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 443, Government Code, is amended by
1212 adding Section 443.029 to read as follows:
1313 Sec. 443.029. GOVERNOR'S MANSION. (a) Except as otherwise
1414 specifically provided by law, the board is responsible for the
1515 preservation and maintenance of the Governor's Mansion and the
1616 protection of the historical and architectural integrity of the
1717 mansion's exterior, interior, and grounds. This section does not
1818 limit the authority of the Texas Historical Commission under
1919 Chapter 191, Natural Resources Code.
2020 (b) Except for a change in or to the Pease bedroom, the Sam
2121 Houston bedroom, the hallway, or the stairwell, a nonstructural
2222 decorative change in or to the private living and guest quarters of
2323 the governor and the governor's family on the second floor of the
2424 Governor's Mansion does not require the prior approval of the board
2525 or the Texas Historical Commission.
2626 (c) The Texas Historical Commission and the office of the
2727 governor may exercise the powers and shall perform the duties
2828 relating to the Governor's Mansion that are provided by applicable
2929 law, subject to the requirements of this section.
3030 SECTION 2. The heading to Section 442.0071, Government
3131 Code, is amended to read as follows:
3232 Sec. 442.0071. DUTIES REGARDING [PRESERVATION AND
3333 MAINTENANCE OF] GOVERNOR'S MANSION.
3434 SECTION 3. Section 442.0071, Government Code, is amended
3535 by amending Subsections (a), (c), and (e) and adding Subsection (f)
3636 to read as follows:
3737 (a) The [Except as otherwise specifically provided by this
3838 section, the] commission shall approve construction plans and
3939 monitor the work on the Governor's Mansion to ensure compliance
4040 with Chapter 191, Natural Resources Code, to ensure [is solely
4141 responsible for the preservation and maintenance of the Governor's
4242 Mansion and the protection of] the historical and architectural
4343 integrity of the mansion's exterior, interior, contents, and
4444 grounds. A [Except as provided by Subsection (d), a] substantial
4545 addition, deletion, or other alteration may not be made to the
4646 mansion or its contents or grounds without the prior approval of the
4747 commission.
4848 (c) The commission may accept gifts, grants, or other
4949 donations on behalf of the Governor's Mansion. The commission
5050 shall contract with a nonprofit organization formed to assist in
5151 the preservation and maintenance of the Governor's Mansion to
5252 develop and implement a plan for the solicitation and acceptance of
5353 gifts, grants, devises, and bequests of money, other property, and
5454 services to be used in the acquisition of furnishings, fixtures,
5555 works of art, and decorative objects for the Governor's Mansion or
5656 for necessary landscaping, conservation, or restoration services.
5757 The commission also may contract with a nonprofit organization
5858 described by this subsection for the performance of any duty
5959 provided by Subsection (b). A contract under this subsection may
6060 not exceed a term of two years [and must expire on December 31 of an
6161 odd-numbered year].
6262 (e) The State Preservation Board [Purchasing and General
6363 Services Commission] and the office of the governor may exercise
6464 the powers and shall perform the duties relating to the Governor's
6565 Mansion that are provided by applicable law, subject to the
6666 requirements of this section.
6767 (f) Section 443.007 does not apply to this section.
6868 SECTION 4. Section 442.0071(d), Government Code, is
6969 repealed.
7070 SECTION 5. This Act takes effect immediately if it receives
7171 a vote of two-thirds of all the members elected to each house, as
7272 provided by Section 39, Article III, Texas Constitution. If this
7373 Act does not receive the vote necessary for immediate effect, this
7474 Act takes effect September 1, 2009.
