A BILL TO BE ENTITLED
AN ACT
relating to equitable funding under the public school finance
system.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter E, Chapter 42, Education Code, is
amended by adding Section 42.25162 to read as follows:
Sec. 42.25162. ADJUSTMENT TO INCREASE EQUITY. (a) In this
section:
(1) "Wealth per student" has the meaning assigned by
Section 41.001.
(2) "Weighted average daily attendance" has the
meaning assigned by Section 42.302.
(b) Notwithstanding any other provision of this title, the
commissioner shall make adjustments to amounts due to a school
district under this chapter or to amounts necessary for a district
to comply with the requirements of Chapter 41 as appropriate to
reduce by $1,000 the difference, as calculated on the basis of
funding provided for the 2008-2009 school year, between:
(1) the amount of state and local revenue per student
in weighted average daily attendance available to a district at the
highest wealth per student in this state; and
(2) the amount of state and local revenue per student
in weighted average daily attendance available to a district at the
lowest wealth per student in this state.
SECTION 2. This Act takes effect September 1, 2009.
