9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Article 2.131, Code of Criminal Procedure, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | Art. 2.131. RACIAL PROFILING PROHIBITED. (a) A peace | |
13 | 13 | officer may not engage in racial profiling. | |
14 | 14 | (b) A civilian employee of the Department of Public Safety | |
15 | 15 | assigned to a driver's license facility of that department may not | |
16 | 16 | engage in racial profiling in issuing an original, renewal, or | |
17 | 17 | duplicate driver's license, commercial driver's license, or | |
18 | 18 | personal identification certificate. | |
19 | 19 | SECTION 2. Article 2.132, Code of Criminal Procedure, is | |
20 | 20 | amended by adding Subsection (g) to read as follows: | |
21 | 21 | (g) To the extent that they can be made applicable, the | |
22 | 22 | provisions of Subsections (b)(1), (2), (3), (4), and (5) also apply | |
23 | 23 | to civilian employees of the Department of Public Safety who are | |
24 | 24 | assigned to the driver's license facilities of the department. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2009. |
