77 relating to the prevention of racial profiling by certain civilian
88 employees of the Department of Public Safety.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 2.131, Code of Criminal Procedure, is
1111 amended to read as follows:
1212 Art. 2.131. RACIAL PROFILING PROHIBITED. (a) A peace
1313 officer may not engage in racial profiling.
1414 (b) A civilian employee of the Department of Public Safety
1515 assigned to a driver's license facility of that department may not
1616 engage in racial profiling in issuing an original, renewal, or
1717 duplicate driver's license, commercial driver's license, or
1818 personal identification certificate.
1919 SECTION 2. Article 2.132, Code of Criminal Procedure, is
2020 amended by adding Subsection (g) to read as follows:
2121 (g) To the extent that they can be made applicable, the
2222 provisions of Subsections (b)(1), (2), (3), (4), and (5) also apply
2323 to civilian employees of the Department of Public Safety who are
2424 assigned to the driver's license facilities of the department.
2525 SECTION 3. This Act takes effect September 1, 2009.
