 A BILL TO BE ENTITLED
 AN ACT
 relating to the prevention of racial profiling by certain civilian
 employees of the Department of Public Safety.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Article 2.131, Code of Criminal Procedure, is
 amended to read as follows:
 Art. 2.131. RACIAL PROFILING PROHIBITED. (a) A peace
 officer may not engage in racial profiling.
 (b)  A civilian employee of the Department of Public Safety
 assigned to a driver's license facility of that department may not
 engage in racial profiling in issuing an original, renewal, or
 duplicate driver's license, commercial driver's license, or
 personal identification certificate.
 SECTION 2. Article 2.132, Code of Criminal Procedure, is
 amended by adding Subsection (g) to read as follows:
 (g)  To the extent that they can be made applicable, the
 provisions of Subsections (b)(1), (2), (3), (4), and (5) also apply
 to civilian employees of the Department of Public Safety who are
 assigned to the driver's license facilities of the department.
 SECTION 3. This Act takes effect September 1, 2009.
