| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 37.001(2), Utilities Code, is amended to | |
| 11 | 11 | read as follows: | |
| 12 | 12 | (2) "Electric utility" includes: | |
| 13 | 13 | (A) an electric cooperative; and | |
| 14 | 14 | (B) a municipally owned utility when the utility | |
| 15 | 15 | is operating outside the municipality. | |
| 16 | 16 | SECTION 2. This Act applies only to service to or | |
| 17 | 17 | construction in an area that had not begun before the effective date | |
| 18 | 18 | of this Act. Service to or construction in an area that began | |
| 19 | 19 | before the effective date of this Act is governed by the law in | |
| 20 | 20 | effect on the date the service or construction began, and that law | |
| 21 | 21 | is continued in effect for that purpose. | |
| 22 | 22 | SECTION 3. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2009. |
