A BILL TO BE ENTITLED
AN ACT
relating to the duties of a municipally owned electric utility when
operating outside the municipality.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 37.001(2), Utilities Code, is amended to
read as follows:
(2) "Electric utility" includes:
(A) an electric cooperative; and
(B) a municipally owned utility when the utility
is operating outside the municipality.
SECTION 2. This Act applies only to service to or
construction in an area that had not begun before the effective date
of this Act. Service to or construction in an area that began
before the effective date of this Act is governed by the law in
effect on the date the service or construction began, and that law
is continued in effect for that purpose.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
