| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife |
|---|
| 9 | 9 | | Code, is amended by adding Section 11.0285 to read as follows: |
|---|
| 10 | 10 | | Sec. 11.0285. DONATED BUILDING PROJECTS. (a) The department |
|---|
| 11 | 11 | | may accept the donation of a turnkey building project on state land |
|---|
| 12 | 12 | | provided that the department: |
|---|
| 13 | 13 | | (1) approves the plans and engineering in advance; and |
|---|
| 14 | 14 | | (2) has supervision over the project. |
|---|
| 15 | 15 | | (b) A project under this section is not subject to |
|---|
| 16 | 16 | | competitive bidding. |
|---|
| 17 | 17 | | (c) The commission may adopt rules to implement this |
|---|
| 18 | 18 | | section. |
|---|
| 19 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2009. |
