| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 61, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 61.0801 to read as follows: |
|---|
| 12 | 12 | | Sec. 61.0801. MEASURES TO ACHIEVE FACULTY DIVERSITY. (a) |
|---|
| 13 | 13 | | The board shall establish a program to assist institutions of |
|---|
| 14 | 14 | | higher education in recruiting and retaining faculty that reflect |
|---|
| 15 | 15 | | the diversity of the population of this state and of the student |
|---|
| 16 | 16 | | population of the institution. Under the program, the board shall: |
|---|
| 17 | 17 | | (1) monitor and compile periodic reports regarding |
|---|
| 18 | 18 | | efforts and progress by institutions in achieving faculty |
|---|
| 19 | 19 | | diversity, including ranking or scoring the progress of |
|---|
| 20 | 20 | | institutions in achieving that diversity; |
|---|
| 21 | 21 | | (2) identify effective measures and strategies that an |
|---|
| 22 | 22 | | institution could use to promote faculty diversity; and |
|---|
| 23 | 23 | | (3) recommend appropriate measures and strategies for |
|---|
| 24 | 24 | | that purpose to specific institutions according to the specific |
|---|
| 25 | 25 | | circumstances of the institution. |
|---|
| 26 | 26 | | (b) The board shall solicit advice from institutions of |
|---|
| 27 | 27 | | higher education with programs that focus on minority or ethnic |
|---|
| 28 | 28 | | studies or issues in identifying and recommending measures and |
|---|
| 29 | 29 | | strategies under this section. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2009. |
