 A BILL TO BE ENTITLED
 AN ACT
 relating to faculty diversity at public institutions of higher
 education.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter C, Chapter 61, Education Code, is
 amended by adding Section 61.0801 to read as follows:
 Sec. 61.0801.  MEASURES TO ACHIEVE FACULTY DIVERSITY. (a)
 The board shall establish a program to assist institutions of
 higher education in recruiting and retaining faculty that reflect
 the diversity of the population of this state and of the student
 population of the institution. Under the program, the board shall:
 (1)  monitor and compile periodic reports regarding
 efforts and progress by institutions in achieving faculty
 diversity, including ranking or scoring the progress of
 institutions in achieving that diversity;
 (2)  identify effective measures and strategies that an
 institution could use to promote faculty diversity; and
 (3)  recommend appropriate measures and strategies for
 that purpose to specific institutions according to the specific
 circumstances of the institution.
 (b)  The board shall solicit advice from institutions of
 higher education with programs that focus on minority or ethnic
 studies or issues in identifying and recommending measures and
 strategies under this section.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
