| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 1452.101(5), Insurance Code, is amended |
|---|
| 9 | 9 | | to read as follows: |
|---|
| 10 | 10 | | (5) "Medical group" means: |
|---|
| 11 | 11 | | (A) a single legal entity owned by two or more |
|---|
| 12 | 12 | | physicians; |
|---|
| 13 | 13 | | (B) a professional association composed of |
|---|
| 14 | 14 | | licensed physicians; [corporation] or |
|---|
| 15 | 15 | | (C) any other business entity composed of |
|---|
| 16 | 16 | | licensed physicians as permitted under Subchapter B, Chapter 162, |
|---|
| 17 | 17 | | Occupations Code. |
|---|
| 18 | 18 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 19 | 19 | | to credentialing of a physician under a contract entered into or |
|---|
| 20 | 20 | | renewed by a medical group and an issuer of a managed care plan on or |
|---|
| 21 | 21 | | after the effective date of this Act. A contract entered into or |
|---|
| 22 | 22 | | renewed before the effective date of this Act is governed by the law |
|---|
| 23 | 23 | | in effect immediately before that date, and that law is continued in |
|---|
| 24 | 24 | | effect for that purpose. |

| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2009. |
