66 AN ACT
77 relating to certain offenses involving public and private schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 37.107, Education Code, is amended to
1010 read as follows:
1111 Sec. 37.107. TRESPASS ON SCHOOL GROUNDS. (a) An
1212 unauthorized person who trespasses on the grounds of any school
1313 district of this state commits an offense. An offense under this
1414 section is a Class C misdemeanor.
1515 (b) Subsection (a) does not apply to a student who is on the
1616 grounds of the school campus the student attends.
1717 SECTION 2. The heading to Section 37.123, Education Code,
1818 is amended to read as follows:
1919 Sec. 37.123. OBSTRUCTIVE [DISRUPTIVE] ACTIVITIES.
2020 SECTION 3. Section 37.123, Education Code, is amended by
2121 amending Subsections (a) and (b) and adding Subsection (b-1) to
2222 read as follows:
2323 (a) A person commits an offense if the person, alone or in
2424 concert with others, intentionally engages in obstructive
2525 [disruptive] activity on the campus or property of any private or
2626 public school.
2727 (b) For purposes of this section, obstructive [disruptive]
2828 activity is:
2929 (1) obstructing or restraining the passage of persons
3030 in an exit, entrance, or hallway of a building without the
3131 authorization of the administration of the school;
3232 (2) seizing control of a building or portion of a
3333 building to interfere with an administrative, educational,
3434 research, or other authorized activity;
3535 (3) preventing, disrupting, or attempting to prevent
3636 or disrupt by force or violence or the threat of force or violence a
3737 lawful assembly authorized by the school administration so that a
3838 person attempting to participate in the assembly is unable to
3939 participate due to the use of force or violence or due to a
4040 reasonable fear that force or violence is likely to occur; or
4141 (4) [disrupting by force or violence or the threat of
4242 force or violence a lawful assembly in progress; or
4343 [(5)] obstructing or restraining the passage of a
4444 person at an exit or entrance to the campus or property or
4545 preventing or attempting to prevent by force or violence or by
4646 threats of force or violence the ingress or egress of a person to or
4747 from the property or campus without the authorization of the
4848 administration of the school.
4949 (b-1) In this section, "obstruct" has the meaning assigned
5050 by Section 42.03, Penal Code.
5151 SECTION 4. Section 37.124, Education Code, is amended by
5252 adding Subsection (a-1) to read as follows:
5353 (a-1) Subsection (a) does not apply to a student who is on
5454 the school campus or within 500 feet of the school campus the
5555 student attends.
5656 SECTION 5. Section 37.126, Education Code, is amended by
5757 adding Subsection (a-1) to read as follows:
5858 (a-1) Subsection (a) does not apply to a child who attends
5959 the school to or from which the children are being transported.
6060 SECTION 6. Section 51.935(b), Education Code, is amended to
6161 read as follows:
6262 (b) For purposes of this section, disruptive activity is:
6363 (1) obstructing or restraining the passage of persons
6464 in an exit, entrance, or hallway of a building without the
6565 authorization of the administration of the institution of higher
6666 education;
6767 (2) seizing control of a building or portion of a
6868 building to interfere with an administrative, educational,
6969 research, or other authorized activity;
7070 (3) preventing or attempting to prevent by force or
7171 violence or the threat of force or violence a lawful assembly
7272 authorized by the administration of the institution of higher
7373 education so that a person attempting to participate in the
7474 assembly is unable to participate due to the use of force or
7575 violence or due to a reasonable fear that force or violence is
7676 likely to occur;
7777 (4) disrupting by force or violence or the threat of
7878 force or violence a lawful assembly in progress; or
7979 (5) obstructing or restraining the passage of a person
8080 at an exit or entrance to the campus or property or preventing or
8181 attempting to prevent by force or violence or by threats of force or
8282 violence the ingress or egress of a person to or from the property
8383 or campus without the authorization of the administration of the
8484 institution of higher education [activity described by Section
8585 37.123(b)].
8686 SECTION 7. Section 37.123(d), Education Code, is repealed.
8787 SECTION 8. The changes in law made by this Act apply only to
8888 an offense committed on or after the effective date of this Act. An
8989 offense committed before the effective date of this Act is governed
9090 by the law in effect at the time the offense was committed, and the
9191 former law is continued in effect for that purpose. For the
9292 purposes of this section, an offense was committed before the
9393 effective date of this Act if any element of the offense occurred
9494 before that date.
9595 SECTION 9. This Act takes effect immediately if it receives
9696 a vote of two-thirds of all the members elected to each house, as
9797 provided by Section 39, Article III, Texas Constitution. If this
9898 Act does not receive the vote necessary for immediate effect, this
9999 Act takes effect September 1, 2009.
