77 relating to the establishment of a road user fee pilot program by
88 the Texas Department of Transportation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 222, Transportation Code, is amended by
1111 adding Subchapter F to read as follows:
1212 SUBCHAPTER F. ROAD USER FEE PILOT PROGRAM
1313 Sec. 222.151. DEFINITIONS. In this subchapter:
1414 (1) "Diesel fuel" has the meaning assigned by Section
1515 162.001, Tax Code.
1616 (2) "Gasoline" has the meaning assigned by Section
1717 162.001, Tax Code.
1818 (3) "Program" means a road user fee pilot program
1919 established under this subchapter.
2020 Sec. 222.152. PROGRAM ESTABLISHED. (a) Except as provided
2121 by Subsection (b), the department by rule shall establish a pilot
2222 program in at least one county that is part of a regional mobility
2323 authority established or operating under Chapter 370 to study the
2424 feasibility of assessing a road user fee that is based on the number
2525 of miles traveled in this state by a motor vehicle.
2626 (b) The department may not establish the program in a county
2727 without the approval of the commissioners court of that county.
2828 Sec. 222.153. AMOUNT OF ROAD USER FEE. (a) The department
2929 by rule shall set the amount of the road user fee on a per mile
3030 basis.
3131 (b) In prescribing the amount of the fee, the department
3232 shall determine the average amount of taxes imposed under Chapter
3333 162, Tax Code, per mile on gasoline or diesel fuel used to propel an
3434 average motor vehicle over the public roadways of this state.
3535 (c) The department shall set the fee in an amount equal to
3636 the amount determined under Subsection (b).
3737 (d) The department shall allow a person who participates in
3838 the program a credit against the fee imposed for use of a motor
3939 vehicle equal to the amount of any taxes paid under Chapter 162,
4040 Tax Code, for gasoline or diesel fuel used in the vehicle during the
4141 period on which the amount of the fee paid is based.
4242 Sec. 222.154. DEPOSIT OF NET REVENUE. The department shall
4343 deposit the net revenue from the fee imposed under this subchapter
4444 to the credit of the state highway fund.
4545 Sec. 222.155. ELIGIBILITY. In establishing the pilot
4646 program, the department shall consult with the regional mobility
4747 authority of which the county is a part to develop criteria for
4848 voluntary program participation. The criteria must include
4949 requirements that a person must:
5050 (1) reside in a county that is participating in the
5151 program;
5252 (2) possess a valid driver's license issued to that
5353 person by this state;
5454 (3) own a motor vehicle that is registered in this
5555 state; and
5656 (4) agree to rules adopted by the department.
5757 Sec. 222.156. CONTRACTS. The department may contract with
5858 the regional mobility authority of which the county is a part or The
5959 Texas A&M University System, or both, to implement or administer
6060 all or any part of the program.
6161 Sec. 222.157. PROMOTION OF PROGRAM. Notwithstanding
6262 Chapter 2113, Government Code, the department or an entity with
6363 which the department contracts under Section 222.156 may promote
6464 the program by appropriate means, including advertising or
6565 marketing as the department or the entity determines appropriate.
6666 Sec. 222.158. REPORT. Not later than January 31, 2012, the
6767 department shall submit to the legislature a report that includes
6868 recommendations regarding:
6969 (1) the feasibility of assessing a road user fee that
7070 is based on the number of miles traveled in this state by a motor
7171 vehicle; and
7272 (2) legislation to implement a road user fee in this
7373 state.
7474 Sec. 222.159. EXPIRATION. This subchapter expires
7575 September 1, 2013.
7676 SECTION 2. Not later than December 31, 2010, the Texas
7777 Department of Transportation shall establish a pilot program as
7878 required by Section 222.152, Transportation Code, as added by this
7979 Act.
8080 SECTION 3. This Act takes effect September 1, 2009.
