55 relating to veterinarian reports of diseased animals.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Sections 161.101(a) and (b), Agriculture Code,
88 are amended to read as follows:
99 (a) A veterinarian, a veterinary diagnostic laboratory, or
1010 a person having care, custody, or control of an animal shall report
1111 the existence of the following diseases among livestock, exotic
1212 livestock, bison, domestic fowl, or exotic fowl to the commission
1313 within 24 hours after diagnosis of the disease:
1414 (1) anthrax;
1515 (2) avian infectious laryngotracheitis;
1616 (3) avian influenza;
1717 (4) avian tuberculosis;
1818 (5) bovine trichomoniasis;
1919 (6) chronic wasting disease;
2020 (7) [(6)] duck virus enteritis;
2121 (8) [(7)] duck virus hepatitis;
2222 (9) [(8)] equine encephalomyelitis;
2323 (10) equine herpes virus-1;
2424 (11) [(9)] equine infectious anemia;
2525 (12) equine viral arteritis;
2626 (13) [(10)] infectious encephalomyelitis in poultry
2727 or other fowl;
2828 (14) [(11)] ornithosis;
2929 (15) [(12)] paramyxovirus infection in poultry or
3030 other fowl; or
3131 (16) [(13)] scabies in sheep or cattle.
3232 (b) In addition to reporting required by Subsection (a), the
3333 commission may adopt rules that require a veterinarian, a
3434 veterinary diagnostic laboratory, or a person having care, custody,
3535 or control of an animal to report the existence of a disease other
3636 than bluetongue in an animal to the commission within 24 hours after
3737 diagnosis if the disease:
3838 (1) is recognized by the United States Department of
3939 Agriculture as a foreign animal disease;
4040 (2) is the subject of a cooperative eradication
4141 program with the United States Department of Agriculture;
4242 (3) is a disease reportable to [named on "List A" of]
4343 the Office International Des Epizooties; or
4444 (4) is the subject of a state of emergency, as declared
4545 by the governor.
4646 SECTION 2. The change in law made by this Act applies only
4747 to a diagnosis made on or after the effective date of this Act. A
4848 diagnosis made before the effective date of this Act is covered by
4949 the law in effect immediately before that date, and the former law
5050 is continued in effect for that purpose.
5151 SECTION 3. This Act takes effect September 1, 2009.
