5	5	relating to veterinarian reports of diseased animals.
6	6	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	7	SECTION 1. Sections 161.101(a) and (b), Agriculture Code,
8	8	are amended to read as follows:
9	9	(a) A veterinarian, a veterinary diagnostic laboratory, or
10	10	a person having care, custody, or control of an animal shall report
11	11	the existence of the following diseases among livestock, exotic
12	12	livestock, bison, domestic fowl, or exotic fowl to the commission
13	13	within 24 hours after diagnosis of the disease:
14	14	(1) anthrax;
15	15	(2) avian infectious laryngotracheitis;
16	16	(3) avian influenza;
17	17	(4) avian tuberculosis;
18	18	(5) bovine trichomoniasis;
19	19	(6) chronic wasting disease;
20	20	(7) [(6)] duck virus enteritis;
21	21	(8) [(7)] duck virus hepatitis;
22	22	(9) [(8)] equine encephalomyelitis;
23	23	(10) equine herpes virus-1;
24	24	(11) [(9)] equine infectious anemia;
25	25	(12) equine viral arteritis;
26	26	(13) [(10)] infectious encephalomyelitis in poultry
27	27	or other fowl;
28	28	(14) [(11)] ornithosis;
29	29	(15) [(12)] paramyxovirus infection in poultry or
30	30	other fowl; or
31	31	(16) [(13)] scabies in sheep or cattle.
32	32	(b) In addition to reporting required by Subsection (a), the
33	33	commission may adopt rules that require a veterinarian, a
34	34	veterinary diagnostic laboratory, or a person having care, custody,
35	35	or control of an animal to report the existence of a disease other
36	36	than bluetongue in an animal to the commission within 24 hours after
37	37	diagnosis if the disease:
38	38	(1) is recognized by the United States Department of
39	39	Agriculture as a foreign animal disease;
40	40	(2) is the subject of a cooperative eradication
41	41	program with the United States Department of Agriculture;
42	42	(3) is a disease reportable to [named on "List A" of]
43	43	the Office International Des Epizooties; or
44	44	(4) is the subject of a state of emergency, as declared
45	45	by the governor.
46	46	SECTION 2. The change in law made by this Act applies only
47	47	to a diagnosis made on or after the effective date of this Act. A
48	48	diagnosis made before the effective date of this Act is covered by
49	49	the law in effect immediately before that date, and the former law
50	50	is continued in effect for that purpose.
51	51	SECTION 3. This Act takes effect September 1, 2009.
