77 relating to motor vehicle emissions inspections for certain salvage
88 vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter F, Chapter 548, Transportation Code,
1111 is amended by adding Section 548.308 to read as follows:
1212 Sec. 548.308. CERTAIN SALVAGE VEHICLES. (a) This section
1313 applies only to a motor vehicle to be titled or registered in a
1414 county with a motor vehicle emissions inspection and maintenance
1515 program.
1616 (b) Notwithstanding other provisions of this subchapter, a
1717 salvage vehicle for which a certificate of title is applied for
1818 under Section 501.100 shall be required to pass an acceleration
1919 simulation mode (ASM2) test or two-speed idle (TSI) test, instead
2020 of an on-board diagnostic II (OBDII) test, if the vehicle undergoes
2121 the on-board diagnostic II (OBDII) test and the results indicate
2222 that the vehicle has not completed a drive cycle.
2323 (c) A motor vehicle for which a regular certificate of title
2424 is issued under Section 501.100 is required to pass the regular
2525 approved vehicle emissions test for the county in which it is to be
2626 registered.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2009.
