| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter F, Chapter 548, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 548.308 to read as follows: |
|---|
| 12 | 12 | | Sec. 548.308. CERTAIN SALVAGE VEHICLES. (a) This section |
|---|
| 13 | 13 | | applies only to a motor vehicle to be titled or registered in a |
|---|
| 14 | 14 | | county with a motor vehicle emissions inspection and maintenance |
|---|
| 15 | 15 | | program. |
|---|
| 16 | 16 | | (b) Notwithstanding other provisions of this subchapter, a |
|---|
| 17 | 17 | | salvage vehicle for which a certificate of title is applied for |
|---|
| 18 | 18 | | under Section 501.100 shall be required to pass an acceleration |
|---|
| 19 | 19 | | simulation mode (ASM2) test or two-speed idle (TSI) test, instead |
|---|
| 20 | 20 | | of an on-board diagnostic II (OBDII) test, if the vehicle undergoes |
|---|
| 21 | 21 | | the on-board diagnostic II (OBDII) test and the results indicate |
|---|
| 22 | 22 | | that the vehicle has not completed a drive cycle. |
|---|
| 23 | 23 | | (c) A motor vehicle for which a regular certificate of title |
|---|
| 24 | 24 | | is issued under Section 501.100 is required to pass the regular |
|---|
| 25 | 25 | | approved vehicle emissions test for the county in which it is to be |
|---|
| 26 | 26 | | registered. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
