 A BILL TO BE ENTITLED
 AN ACT
 relating to motor vehicle emissions inspections for certain salvage
 vehicles.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter F, Chapter 548, Transportation Code,
 is amended by adding Section 548.308 to read as follows:
 Sec. 548.308.  CERTAIN SALVAGE VEHICLES.  (a)  This section
 applies only to a motor vehicle to be titled or registered in a
 county with a motor vehicle emissions inspection and maintenance
 program.
 (b)  Notwithstanding other provisions of this subchapter, a
 salvage vehicle for which a certificate of title is applied for
 under Section 501.100 shall be required to pass an acceleration
 simulation mode (ASM2) test or two-speed idle (TSI) test, instead
 of an on-board diagnostic II (OBDII) test, if the vehicle undergoes
 the on-board diagnostic II (OBDII) test and the results indicate
 that the vehicle has not completed a drive cycle.
 (c)  A motor vehicle for which a regular certificate of title
 is issued under Section 501.100 is required to pass the regular
 approved vehicle emissions test for the county in which it is to be
 registered.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
