| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Chapter 280, Local Government Code, is amended |
|---|
| 14 | 14 | | by adding Section 280.005 to read as follows: |
|---|
| 15 | 15 | | Sec. 280.005. ACQUISITION OF BUFFER AREA ADJACENT TO |
|---|
| 16 | 16 | | MILITARY INSTALLATION AUTHORIZED. A municipality or county may |
|---|
| 17 | 17 | | issue bonds or notes, including tax increment bonds or notes |
|---|
| 18 | 18 | | authorized under Chapter 311, Tax Code, to finance the acquisition |
|---|
| 19 | 19 | | of buffer areas or open spaces adjacent to a military installation |
|---|
| 20 | 20 | | for the prevention of encroachment or for the construction of |
|---|
| 21 | 21 | | roadways, utilities, or other infrastructure to protect or promote |
|---|
| 22 | 22 | | the mission of the military installation. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect December 1, 2009, but only |
|---|
| 24 | 24 | | if the constitutional amendment proposed by the 81st Legislature, |
|---|
| 25 | 25 | | Regular Session, 2009, authorizing the financing, including |
|---|
| 26 | 26 | | through tax increment financing, of the acquisition by |
|---|
| 27 | 27 | | municipalities and counties of buffer areas or open spaces adjacent |
|---|
| 28 | 28 | | to a military installation for the prevention of encroachment or |
|---|
| 29 | 29 | | for the construction of roadways, utilities, or other |
|---|
| 30 | 30 | | infrastructure to protect or promote the mission of the military |
|---|
| 31 | 31 | | installation is approved by the voters. If that amendment is not |
|---|
| 32 | 32 | | approved, this Act has no effect. |
