99 relating municipal and county financing of the acquisition of
1010 buffer areas or open spaces adjacent to a military installation for
1111 certain purposes.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 280, Local Government Code, is amended
1414 by adding Section 280.005 to read as follows:
1515 Sec. 280.005. ACQUISITION OF BUFFER AREA ADJACENT TO
1616 MILITARY INSTALLATION AUTHORIZED. A municipality or county may
1717 issue bonds or notes, including tax increment bonds or notes
1818 authorized under Chapter 311, Tax Code, to finance the acquisition
1919 of buffer areas or open spaces adjacent to a military installation
2020 for the prevention of encroachment or for the construction of
2121 roadways, utilities, or other infrastructure to protect or promote
2222 the mission of the military installation.
2323 SECTION 2. This Act takes effect December 1, 2009, but only
2424 if the constitutional amendment proposed by the 81st Legislature,
2525 Regular Session, 2009, authorizing the financing, including
2626 through tax increment financing, of the acquisition by
2727 municipalities and counties of buffer areas or open spaces adjacent
2828 to a military installation for the prevention of encroachment or
2929 for the construction of roadways, utilities, or other
3030 infrastructure to protect or promote the mission of the military
3131 installation is approved by the voters. If that amendment is not
3232 approved, this Act has no effect.
