 A BILL TO BE ENTITLED
 AN ACT
 relating municipal and county financing of the acquisition of
 buffer areas or open spaces adjacent to a military installation for
 certain purposes.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Chapter 280, Local Government Code, is amended
 by adding Section 280.005 to read as follows:
 Sec. 280.005.  ACQUISITION OF BUFFER AREA ADJACENT TO
 MILITARY INSTALLATION AUTHORIZED. A municipality or county may
 issue bonds or notes, including tax increment bonds or notes
 authorized under Chapter 311, Tax Code, to finance the acquisition
 of buffer areas or open spaces adjacent to a military installation
 for the prevention of encroachment or for the construction of
 roadways, utilities, or other infrastructure to protect or promote
 the mission of the military installation.
 SECTION 2. This Act takes effect December 1, 2009, but only
 if the constitutional amendment proposed by the 81st Legislature,
 Regular Session, 2009, authorizing the financing, including
 through tax increment financing, of the acquisition by
 municipalities and counties of buffer areas or open spaces adjacent
 to a military installation for the prevention of encroachment or
 for the construction of roadways, utilities, or other
 infrastructure to protect or promote the mission of the military
 installation is approved by the voters. If that amendment is not
 approved, this Act has no effect.
