44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the exemption of certain personal property from
77 garnishment, attachment, execution, or other seizure.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 42.001(b), Property Code, is amended to
1010 read as follows:
1111 (b) The following personal property is exempt from seizure
1212 and is not included in the aggregate limitations prescribed by
1313 Subsection (a):
1414 (1) current wages for personal services, except for
1515 the enforcement of court-ordered child support payments;
1616 (2) professionally prescribed health aids of a debtor
1717 or a dependent of a debtor;
1818 (3) alimony, support, or separate maintenance
1919 received or to be received by the debtor for the support of the
2020 debtor or a dependent of the debtor; [and]
2121 (4) a religious bible or other book containing sacred
2222 writings of a religion that is seized by a creditor other than a
2323 lessor of real property who is exercising the lessor's contractual
2424 or statutory right to seize personal property after a tenant
2525 breaches a lease agreement for or abandons the real property; and
2626 (5) social security benefits, unemployment
2727 compensation, public assistance benefits, veterans' benefits,
2828 awards under a crime victim's reparation law, payments for wrongful
2929 death, or payments for loss of earnings.
3030 SECTION 2. Section 42.002(a), Property Code, is amended to
3131 read as follows:
3232 (a) The following personal property is exempt under Section
3333 42.001(a):
3434 (1) home furnishings, including family heirlooms;
3535 (2) provisions for consumption;
3636 (3) farming or ranching vehicles and implements;
3737 (4) tools, equipment, books, and apparatus, including
3838 boats and motor vehicles used in a trade or profession;
3939 (5) wearing apparel;
4040 (6) jewelry not to exceed 25 percent of the aggregate
4141 limitations prescribed by Section 42.001(a);
4242 (7) two firearms;
4343 (8) athletic and sporting equipment, including
4444 bicycles;
4545 (9) a two-wheeled, three-wheeled, or four-wheeled
4646 motor vehicle for each member of a family or single adult who holds
4747 a driver's license or who does not hold a driver's license but who
4848 relies on another person to operate the vehicle for the benefit of
4949 the nonlicensed person;
5050 (10) the following animals and forage on hand for
5151 their consumption:
5252 (A) two horses, mules, or donkeys and a saddle,
5353 blanket, and bridle for each;
5454 (B) 12 head of cattle;
5555 (C) 60 head of other types of livestock; and
5656 (D) 120 fowl; [and]
5757 (11) household pets;
5858 (12) an unmatured life insurance contract; and
5959 (13) any personal property not specifically listed in
6060 this section, if the total value of all of the personal property
6161 does not exceed the aggregate limitations prescribed by Section
6262 42.001(a).
6363 SECTION 3. The changes in law made by this Act do not apply
6464 to property that is, as of the effective date of this Act, subject
6565 to a voluntary bankruptcy proceeding or to valid claims of a holder
6666 of a final judgment who has, by levy, garnishment, or other legal
6767 process, obtained rights superior to those that would otherwise be
6868 held by a trustee in bankruptcy if a bankruptcy petition were then
6969 pending against the debtor. That property is subject to the law as
7070 it existed immediately before the effective date of this Act, and
7171 the prior law is continued in effect for that purpose.
7272 SECTION 4. This Act takes effect September 1, 2009.
