| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter E, Chapter 223, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 223.2031 to read as follows: |
|---|
| 12 | 12 | | Sec. 223.2031. PUBLIC VIEWING AND COMMENT ON PROPOSALS. |
|---|
| 13 | 13 | | Before the department may make an official decision regarding a |
|---|
| 14 | 14 | | proposal received under Section 223.203, the department must make |
|---|
| 15 | 15 | | the submitted proposals available to the public for review and |
|---|
| 16 | 16 | | comment for a 45-day period. The department shall make available, |
|---|
| 17 | 17 | | to the extent permitted under Section 223.204: |
|---|
| 18 | 18 | | (1) each response to a request for proposals and |
|---|
| 19 | 19 | | qualifications; |
|---|
| 20 | 20 | | (2) each unsolicited proposal considered for |
|---|
| 21 | 21 | | evaluation by the department; |
|---|
| 22 | 22 | | (3) each response to a request for detailed proposals; |
|---|
| 23 | 23 | | and |
|---|
| 24 | 24 | | (4) each detailed proposal as amended after |
|---|
| 25 | 25 | | negotiations. |
|---|
| 26 | 26 | | SECTION 2. Section 223.2031, Transportation Code, as added |
|---|
| 27 | 27 | | by this Act, applies to each proposal received by the Texas |
|---|
| 28 | 28 | | Department of Transportation under Section 223.203, Transportation |
|---|
| 29 | 29 | | Code, on or after September 1, 2009. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2009. |
