A BILL TO BE ENTITLED
AN ACT
relating to public viewing and comment on proposals for
comprehensive development agreements with the Texas Department of
Transportation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter E, Chapter 223, Transportation Code,
is amended by adding Section 223.2031 to read as follows:
Sec. 223.2031. PUBLIC VIEWING AND COMMENT ON PROPOSALS.
Before the department may make an official decision regarding a
proposal received under Section 223.203, the department must make
the submitted proposals available to the public for review and
comment for a 45-day period. The department shall make available,
to the extent permitted under Section 223.204:
(1) each response to a request for proposals and
qualifications;
(2) each unsolicited proposal considered for
evaluation by the department;
(3) each response to a request for detailed proposals;
and
(4) each detailed proposal as amended after
negotiations.
SECTION 2. Section 223.2031, Transportation Code, as added
by this Act, applies to each proposal received by the Texas
Department of Transportation under Section 223.203, Transportation
Code, on or after September 1, 2009.
SECTION 3. This Act takes effect September 1, 2009.
