11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
---|
13 | 13 | | amended by adding Section 51.9051 to read as follows: |

14 | 14 | | Sec. 51.9051. PRESERVING INSTITUTION NAME BASED ON STATE |
---|
15 | 15 | | HISTORICAL FIGURE. (a) In this section, "general academic |
---|
16 | 16 | | teaching institution," "governing board," and "public state |
---|
17 | 17 | | college" have the meanings assigned by Section 61.003. |
---|
18 | 18 | | (b) The Texas Higher Education Coordinating Board shall |
---|
19 | 19 | | maintain a registry that includes each general academic teaching |
---|
20 | 20 | | institution, other than a public state college, that is named after |
---|
21 | 21 | | an established historical figure of this state, as determined by |
---|
22 | 22 | | the coordinating board in consultation with the Texas Historical |
---|
23 | 23 | | Commission. |
---|
24 | 24 | | (c) The governing board of an institution included on the |
---|
25 | 25 | | registry may not change the name of the institution in a manner that |
---|
26 | 26 | | removes the name of the established historical figure from the name |
---|
27 | 27 | | of the institution. |
---|
28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
---|
29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
---|
30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
---|
32 | 32 | | Act takes effect September 1, 2009. |
