77 AN ACT
88 relating to a prohibition against changing the name of certain
99 public institutions of higher education that are named after state
1010 historical figures.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1313 amended by adding Section 51.9051 to read as follows:
1414 Sec. 51.9051. PRESERVING INSTITUTION NAME BASED ON STATE
1515 HISTORICAL FIGURE. (a) In this section, "general academic
1616 teaching institution," "governing board," and "public state
1717 college" have the meanings assigned by Section 61.003.
1818 (b) The Texas Higher Education Coordinating Board shall
1919 maintain a registry that includes each general academic teaching
2020 institution, other than a public state college, that is named after
2121 an established historical figure of this state, as determined by
2222 the coordinating board in consultation with the Texas Historical
2323 Commission.
2424 (c) The governing board of an institution included on the
2525 registry may not change the name of the institution in a manner that
2626 removes the name of the established historical figure from the name
2727 of the institution.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2009.
