66 AN ACT
77 relating to the granting or renewal of certain easements on or
88 leases of certain university land.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 66.46, Education Code, is amended by
1111 adding Subsection (c-1) and amending Subsection (d) to read as
1212 follows:
1313 (c-1) The board of regents may grant or renew an easement on
1414 or lease of university land for new electric or telephone
1515 facilities, or for the extension of existing electric or telephone
1616 facilities, that are eligible for financing under the Rural
1717 Electrification Act of 1936 (7 U.S.C. Section 901 et seq.) without
1818 regard to whether the grantee or lessee applied for financing of the
1919 facilities under that Act.
2020 (d) An easement under this section may not be granted for a
2121 term that is longer than 10 years, but the easement may be renewed
2222 by the board of regents. The rent to be charged for an easement
2323 under this section shall be an amount agreed to by the grantee and
2424 the board, except that any annual privilege fee for an easement
2525 under Subsection (c-1) may not exceed 2-1/2 cents a lineal rod a
2626 year.
2727 SECTION 2. This Act takes effect September 1, 2009.
