9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 66.46, Education Code, is amended by | |
11 | 11 | adding Subsection (c-1) and amending Subsection (d) to read as | |
12 | 12 | follows: | |
13 | 13 | (c-1) The board of regents may grant or renew an easement on | |
14 | 14 | or lease of university land for new electric or telephone | |
15 | 15 | facilities, or for the extension of existing electric or telephone | |
16 | 16 | facilities, that are eligible for financing under the Rural | |
17 | 17 | Electrification Act of 1936 (7 U.S.C. Section 901 et seq.) without | |
18 | 18 | regard to whether the grantee or lessee applied for financing of the | |
19 | 19 | facilities under that Act. | |
20 | 20 | (d) An easement under this section may not be granted for a | |
21 | 21 | term that is longer than 10 years, but the easement may be renewed | |
22 | 22 | by the board of regents. The rent to be charged for an easement | |
23 | 23 | under this section shall be an amount agreed to by the grantee and | |
24 | 24 | the board, except that any annual privilege fee for an easement | |
25 | 25 | under Subsection (c-1) may not exceed 2-1/2 cents a lineal rod a | |
26 | 26 | year. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2009. |
