| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 13.254, Water Code, is amended by adding | |
| 12 | 12 | Subsection (a-5) to read as follows: | |
| 13 | 13 | (a-5) Notwithstanding any other provision of this section, | |
| 14 | 14 | the owner of a tract of land that is at least 300 acres and that is | |
| 15 | 15 | located within the certificated area of a certificate holder may | |
| 16 | 16 | request that the commission decertify the land, if the certificate | |
| 17 | 17 | holder does not provide retail water and sewer service to the land. | |
| 18 | 18 | The commission shall grant a landowner's request under this | |
| 19 | 19 | subsection on receipt of the request. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2009. |
