A BILL TO BE ENTITLED
AN ACT
relating to allowing certain landowners to request that land be
decertified from the service area of a holder of a certificate of
public convenience and necessity.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 13.254, Water Code, is amended by adding
Subsection (a-5) to read as follows:
(a-5) Notwithstanding any other provision of this section,
the owner of a tract of land that is at least 300 acres and that is
located within the certificated area of a certificate holder may
request that the commission decertify the land, if the certificate
holder does not provide retail water and sewer service to the land.
The commission shall grant a landowner's request under this
subsection on receipt of the request.
SECTION 2. This Act takes effect September 1, 2009.
