10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Chapter 485, Health and Safety Code, is amended | |
12 | 12 | by deleting Section 485.019 (b) and re-lettering subsequent | |
13 | 13 | paragraphs accordingly. | |
14 | 14 | Section 2. Chapter 485, Health and Safety Code is further | |
15 | 15 | amended by adding a new Section 485.113 to read as follows: | |
16 | 16 | Sec. 483.113. SURCHARGE ON AEROSOL PAINT SOLD FROM PERMIT | |
17 | 17 | HOLDING FACILITIES. (a) through arraignment with the comptroller, | |
18 | 18 | the board shall collect a twenty-five (25) cent surcharge on each | |
19 | 19 | can of aerosol paint sold at retail through a store holding or | |
20 | 20 | required to hold a valid volatile chemical sales permit; | |
21 | 21 | (b) The comptroller shall deposit the amounts received under | |
22 | 22 | subsection (a) in the state treasury to the credit of general | |
23 | 23 | revenue fund to be used only by the department to: | |
24 | 24 | (1) provide local jurisdictions with funding for values | |
25 | 25 | education, anti-graffiti law enforcement, graffiti abatement and | |
26 | 26 | other directly related uses; and | |
27 | 27 | (2) finance statewide efforts in graffiti prevention and | |
28 | 28 | prevention education. |
