99 AN ACT
1010 relating to rules concerning administration and maintenance of
1111 anaphylaxis medicine on public school campuses.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1414 amended by adding Section 38.0151 to read as follows:
1515 Sec. 38.0151. RULES CONCERNING ADMINISTRATION AND
1616 MAINTENANCE OF ANAPHYLAXIS MEDICINE ON CAMPUS. (a) The
1717 commissioner by rule shall:
1818 (1) adopt standardized procedures for school
1919 personnel to follow if a person on campus experiences an
2020 anaphylactic reaction;
2121 (2) require each school district to maintain a
2222 physician's standing order under which a school nurse is authorized
2323 to administer anaphylaxis medicine to a person on campus
2424 experiencing an anaphylactic reaction; and
2525 (3) require a district to maintain at each campus at
2626 which a school nurse serves on a part-time or full-time basis a
2727 supply of anaphylaxis medicine for administration to a person on
2828 campus experiencing an anaphylactic reaction for the first time.
2929 (b) In adopting rules under Subsection (a), the
3030 commissioner shall consult with one or more physicians experienced
3131 in treating persons experiencing an anaphylactic reaction.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2009.
