| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 2171, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 2171.106 to read as follows: |
|---|
| 12 | 12 | | Sec. 2171.106. APPLICATION OF SUNSET ACT. (a) The office |
|---|
| 13 | 13 | | of vehicle fleet management in the comptroller's office is subject |
|---|
| 14 | 14 | | to Chapter 325 (Texas Sunset Act) as if the office of vehicle fleet |
|---|
| 15 | 15 | | management were a state agency. Unless continued in existence as |
|---|
| 16 | 16 | | provided by that chapter, the office of vehicle fleet management is |
|---|
| 17 | 17 | | abolished and this subchapter expires September 1, 2011. |
|---|
| 18 | 18 | | (b) To the extent Chapter 325 imposes a duty on a state |
|---|
| 19 | 19 | | agency under review, the comptroller's office shall perform that |
|---|
| 20 | 20 | | duty as it relates to the office of vehicle fleet management. |
|---|
| 21 | 21 | | (c) The Sunset Advisory Commission shall include in its |
|---|
| 22 | 22 | | review an analysis of the practical effect of rules adopted by state |
|---|
| 23 | 23 | | agencies under Section 2171.1045. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2009. |
