| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 54.054(a), Transportation Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (a) Except as otherwise provided by this chapter, the board |
|---|
| 11 | 11 | | may award a contract involving the expenditure of funds in excess of |
|---|
| 12 | 12 | | the amount applicable to an expenditure of funds by a municipality |
|---|
| 13 | 13 | | under Section 252.021(a), Local Government Code, [more than |
|---|
| 14 | 14 | | $25,000] only by competitive bidding. |
|---|
| 15 | 15 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 16 | 16 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 17 | 17 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 18 | 18 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 19 | 19 | | Act takes effect September 1, 2009. |
