| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 501, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 501.037 to read as follows: |
|---|
| 12 | 12 | | Sec. 501.037. CERTIFICATE OF TITLE FOR MINI-TRUCK. The |
|---|
| 13 | 13 | | department shall adopt rules and forms for the issuance of a |
|---|
| 14 | 14 | | certificate of title for a mini-truck, as that term is defined by |
|---|
| 15 | 15 | | Section 502.001. |
|---|
| 16 | 16 | | SECTION 2. Section 502.001, Transportation Code, is amended |
|---|
| 17 | 17 | | by adding Subdivision (9-a) to read as follows: |
|---|
| 18 | 18 | | (9-a) "Mini-truck" means a vehicle that: |
|---|
| 19 | 19 | | (A) is powered by an internal combustion engine |
|---|
| 20 | 20 | | with a piston or rotor displacement of 1,000 cubic centimeters or |
|---|
| 21 | 21 | | less; |
|---|
| 22 | 22 | | (B) is less than 67 inches in width; |
|---|
| 23 | 23 | | (C) weighs 3,400 pounds or less; |
|---|
| 24 | 24 | | (D) is operated on four or more tires; |
|---|
| 25 | 25 | | (E) has a top speed of approximately 55 miles per |
|---|
| 26 | 26 | | hour; |
|---|
| 27 | 27 | | (F) is equipped with a bed or compartment for |
|---|
| 28 | 28 | | hauling; and |
|---|
| 29 | 29 | | (G) has an enclosed passenger cab. |
|---|
| 30 | 30 | | SECTION 3. Subchapter A, Chapter 502, Transportation Code, |
|---|
| 31 | 31 | | is amended by adding Section 502.0065 to read as follows: |
|---|
| 32 | 32 | | Sec. 502.0065. MINI-TRUCKS. The department shall establish |
|---|
| 33 | 33 | | rules for the registration of mini-trucks for operation on a public |
|---|
| 34 | 34 | | highway. |
|---|
| 35 | 35 | | SECTION 4. Subchapter I, Chapter 545, Transportation Code, |
|---|
| 36 | 36 | | is amended by adding Section 545.428 to read as follows: |
|---|
| 37 | 37 | | Sec. 545.428. OPERATION OF MINI-TRUCK. (a) A mini-truck |
|---|
| 38 | 38 | | that has been issued a certificate of title under Chapter 501 and |
|---|
| 39 | 39 | | registered under Chapter 502 may be operated: |
|---|
| 40 | 40 | | (1) on a public highway in this state that is not part |
|---|
| 41 | 41 | | of the national system of interstate and defense highways; and |
|---|
| 42 | 42 | | (2) in accordance with this chapter, including rules |
|---|
| 43 | 43 | | adopted under Subchapter (b). |
|---|
| 44 | 44 | | (b) The department by rule may adopt requirements for the |
|---|
| 45 | 45 | | operation of a mini-truck on a public highway. |
|---|
| 46 | 46 | | SECTION 5. This Act takes effect September 1, 2009. |
