 A BILL TO BE ENTITLED
 AN ACT
 relating to the titling, registration, and operation of
 mini-trucks.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter B, Chapter 501, Transportation Code,
 is amended by adding Section 501.037 to read as follows:
 Sec. 501.037.  CERTIFICATE OF TITLE FOR MINI-TRUCK. The
 department shall adopt rules and forms for the issuance of a
 certificate of title for a mini-truck, as that term is defined by
 Section 502.001.
 SECTION 2. Section 502.001, Transportation Code, is amended
 by adding Subdivision (9-a) to read as follows:
 (9-a) "Mini-truck" means a vehicle that:
 (A)  is powered by an internal combustion engine
 with a piston or rotor displacement of 1,000 cubic centimeters or
 less;
 (B) is less than 67 inches in width;
 (C) weighs 3,400 pounds or less;
 (D) is operated on four or more tires;
 (E)  has a top speed of approximately 55 miles per
 hour;
 (F)  is equipped with a bed or compartment for
 hauling; and
 (G) has an enclosed passenger cab.
 SECTION 3. Subchapter A, Chapter 502, Transportation Code,
 is amended by adding Section 502.0065 to read as follows:
 Sec. 502.0065.  MINI-TRUCKS. The department shall establish
 rules for the registration of mini-trucks for operation on a public
 highway.
 SECTION 4. Subchapter I, Chapter 545, Transportation Code,
 is amended by adding Section 545.428 to read as follows:
 Sec. 545.428.  OPERATION OF MINI-TRUCK. (a) A mini-truck
 that has been issued a certificate of title under Chapter 501 and
 registered under Chapter 502 may be operated:
 (1)  on a public highway in this state that is not part
 of the national system of interstate and defense highways; and
 (2)  in accordance with this chapter, including rules
 adopted under Subchapter (b).
 (b)  The department by rule may adopt requirements for the
 operation of a mini-truck on a public highway.
 SECTION 5. This Act takes effect September 1, 2009.
