The bill would add Section 501.0211 to the Election Code regarding a local option election in a certain municipality. The new section would expire on September 1, 2015. The bill would amend Section 501.035, Election Code, to allow areas where the sale of any type or classification of alcoholic beverages is permitted, to permit voting for or against certain types of alcoholic beverage sales. The bill would also repeal Sections 501.035 (d), (e), and (f), of the Elections Code, which relates to the ballot for a prohibitory election in certain areas. The bill would take effect September 1, 2009. Based on analysis by the Texas Alcoholic Beverage Commission, no significant fiscal implication to the state is anticipated.
