55 relating to the sale and consumption of alcoholic beverages.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Chapter 28, Alcoholic Beverage Code, is amended
88 by adding Section 28.101 to read as follows:
99 Sec. 28.101. PUBLIC CONSUMPTION. (a) This section applies
1010 only to a mixed beverage permit holder whose premises are located in
1111 a municipality that:
1212 (1) has a population of less than 15,000;
1313 (2) is located in a county with a population of less
1414 than 65,000; and
1515 (3) contains a historic preservation district that
1616 borders a lake.
1717 (b) Notwithstanding Section 28.10 or any other law, the
1818 holder of a mixed beverage permit whose permitted premises are
1919 located on property owned by a municipality that contains a
2020 municipally owned conference center and that borders a lake may
2121 permit a patron to leave the permitted premises, even though the
2222 patron possesses an alcoholic beverage, if:
2323 (1) the beverage is in an open container and appears to
2424 be possessed for present consumption; and
2525 (2) the public consumption of alcoholic beverages or
2626 possession of an open container of an alcoholic beverage is not
2727 prohibited on the municipally owned property where the permitted
2828 premises are located.
2929 (c) This section does not affect the prohibition against
3030 possessing an open container in a passenger area of a motor vehicle
3131 under Section 49.031, Penal Code.
3232 SECTION 2. Chapter 31, Alcoholic Beverage Code, is amended
3333 by adding Section 31.06 to read as follows:
3434 Sec. 31.06. PUBLIC CONSUMPTION. (a) This section applies
3535 only to the holder of a caterer's permit operating under the permit
3636 in an area in a municipality that:
3737 (1) has a population of less than 15,000;
3838 (2) is located in a county with a population of less
3939 than 65,000; and
4040 (3) contains a historic preservation district that
4141 borders a lake.
4242 (b) Notwithstanding any other law, the holder of a caterer's
4343 permit operating under the permit in an area located on property
4444 owned by a municipality that contains a municipally owned
4545 conference center and that borders a lake may permit a patron to
4646 leave the area, even though the patron possesses an alcoholic
4747 beverage, if:
4848 (1) the beverage is in an open container and appears to
4949 be possessed for present consumption; and
5050 (2) the public consumption of alcoholic beverages or
5151 possession of an open container of an alcoholic beverage is not
5252 prohibited on the municipally owned property where the area is
5353 located.
5454 (c) This section does not affect the prohibition against
5555 possessing an open container in a passenger area of a motor vehicle
5656 under Section 49.031, Penal Code.
5757 SECTION 3. Section 501.035(c), Election Code, is amended to
5858 read as follows:
5959 (c) In an area where the sale of any type or classification
6060 of [all] alcoholic beverages [including mixed beverages] has been
6161 legalized, the ballot for a prohibitory election shall be prepared
6262 to permit voting for or against the one of the following issues that
6363 applies:
6464 (1) "The legal sale of beer for off-premise
6565 consumption only."
6666 (2) "The legal sale of beer."
6767 (3) "The legal sale of beer and wine for off-premise
6868 consumption only."
6969 (4) "The legal sale of beer and wine."
7070 (5) "The legal sale of all alcoholic beverages for
7171 off-premise consumption only."
7272 (6) "The legal sale of all alcoholic beverages except
7373 mixed beverages."
7474 (7) "The legal sale of all alcoholic beverages
7575 including mixed beverages."
7676 (8) "The legal sale of mixed beverages."
7777 (9) "The legal sale of mixed beverages in restaurants
7878 by food and beverage certificate holders only."
7979 (10) "The legal sale of wine on the premises of a
8080 holder of a winery permit."
8181 SECTION 4. Sections 501.035(d), (e), and (f), Election
8282 Code, are repealed.
8383 SECTION 5. This Act takes effect September 1, 2009.
