| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Chapter 81, Insurance Code, is amended by adding | |
| 10 | 10 | Section 81.005 to read as follows: | |
| 11 | 11 | Sec. 81.005. Treatment of Applications and Filings. | |
| 12 | 12 | The department shall diligently process an application, | |
| 13 | 13 | policy, rate or other filing submitted to the department by a person | |
| 14 | 14 | or entity without regard to any pending investigation or compliance | |
| 15 | 15 | proceeding against such person or entity, so long as the | |
| 16 | 16 | allegations or charges therein do not involve intentional injury to | |
| 17 | 17 | an insurance consumer, fraudulent activity, criminal activity, or | |
| 18 | 18 | any other violation, the proof of which would negatively bear on the | |
| 19 | 19 | competence, trustworthiness, experience or integrity of the person | |
| 20 | 20 | or entity. | |
| 21 | 21 | SECTION 2. The change in the law made by this Act applies to | |
| 22 | 22 | all applications or filings pending at the Department of Insurance | |
| 23 | 23 | on the effective date of this Act. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2009. |
