 A BILL TO BE ENTITLED
 AN ACT
 relating to the treatment of applications and filings made at the
 Department of Insurance.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Chapter 81, Insurance Code, is amended by adding
 Section 81.005 to read as follows:
 Sec. 81.005. Treatment of Applications and Filings.
 The department shall diligently process an application,
 policy, rate or other filing submitted to the department by a person
 or entity without regard to any pending investigation or compliance
 proceeding against such person or entity, so long as the
 allegations or charges therein do not involve intentional injury to
 an insurance consumer, fraudulent activity, criminal activity, or
 any other violation, the proof of which would negatively bear on the
 competence, trustworthiness, experience or integrity of the person
 or entity.
 SECTION 2. The change in the law made by this Act applies to
 all applications or filings pending at the Department of Insurance
 on the effective date of this Act.
 SECTION 3. This Act takes effect September 1, 2009.
