| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 382.014, Health and Safety Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | Sec. 382.014. EMISSION INVENTORY. (a) The commission |
|---|
| 16 | 16 | | may require a person whose activities cause emissions of air |
|---|
| 17 | 17 | | contaminants to submit information to enable the commission to |
|---|
| 18 | 18 | | develop an inventory of emissions of air contaminants in this |
|---|
| 19 | 19 | | state. |
|---|
| 20 | 20 | | (b) The commission shall use emissions information |
|---|
| 21 | 21 | | submitted under this section and gathered during other commission |
|---|
| 22 | 22 | | activities to evaluate the integrity of emissions factors and the |
|---|
| 23 | 23 | | emissions inventory. |
|---|
| 24 | 24 | | (c) The commission shall annually assess the information |
|---|
| 25 | 25 | | collected under this section and recommend emissions inventory |
|---|
| 26 | 26 | | improvement strategies in the report required by Section 5.126, |
|---|
| 27 | 27 | | Water Code. |
|---|
| 28 | 28 | | SECTION 2. Section 382.016, Health and Safety Code, is |
|---|
| 29 | 29 | | amended by adding Subsection (c) to read as follows: |
|---|
| 30 | 30 | | (c) The commission may measure and monitor the emissions of |
|---|
| 31 | 31 | | air contaminants from a source or from an activity causing or |
|---|
| 32 | 32 | | resulting in the emission of air contaminants subject to the |
|---|
| 33 | 33 | | commission's jurisdiction. |
|---|
| 34 | 34 | | SECTION 3. Section 382.0173, Health and Safety Code, is |
|---|
| 35 | 35 | | amended by adding Subsection (h) to read as follows: |
|---|
| 36 | 36 | | (h) The commission shall adopt policies to permanently |
|---|
| 37 | 37 | | reduce quantifiable surplus emissions that are found through the |
|---|
| 38 | 38 | | use of any advanced technologies authorized under this chapter to |
|---|
| 39 | 39 | | gain credits for this state's air quality state implementation |
|---|
| 40 | 40 | | plan. |
|---|
| 41 | 41 | | SECTION 4. Section 382.021, Health and Safety Code, is |
|---|
| 42 | 42 | | amended by adding Subsection (c) to read as follows: |
|---|
| 43 | 43 | | (c) The commission shall use optical gas imaging in |
|---|
| 44 | 44 | | two-dimensional vertical fields or other technologies that measure |
|---|
| 45 | 45 | | the concentration and volume of emissions of volatile organic |
|---|
| 46 | 46 | | compounds and nitrogen oxides. |
|---|
| 47 | 47 | | SECTION 5. This Act takes effect September 1, 2009. |
