99 relating to the use of advanced technologies by the Texas
1010 Commission on Environmental Quality for measuring and monitoring
1111 air pollution.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 382.014, Health and Safety Code, is
1414 amended to read as follows:
1515 Sec. 382.014. EMISSION INVENTORY. (a) The commission
1616 may require a person whose activities cause emissions of air
1717 contaminants to submit information to enable the commission to
1818 develop an inventory of emissions of air contaminants in this
1919 state.
2020 (b) The commission shall use emissions information
2121 submitted under this section and gathered during other commission
2222 activities to evaluate the integrity of emissions factors and the
2323 emissions inventory.
2424 (c) The commission shall annually assess the information
2525 collected under this section and recommend emissions inventory
2626 improvement strategies in the report required by Section 5.126,
2727 Water Code.
2828 SECTION 2. Section 382.016, Health and Safety Code, is
2929 amended by adding Subsection (c) to read as follows:
3030 (c) The commission may measure and monitor the emissions of
3131 air contaminants from a source or from an activity causing or
3232 resulting in the emission of air contaminants subject to the
3333 commission's jurisdiction.
3434 SECTION 3. Section 382.0173, Health and Safety Code, is
3535 amended by adding Subsection (h) to read as follows:
3636 (h) The commission shall adopt policies to permanently
3737 reduce quantifiable surplus emissions that are found through the
3838 use of any advanced technologies authorized under this chapter to
3939 gain credits for this state's air quality state implementation
4040 plan.
4141 SECTION 4. Section 382.021, Health and Safety Code, is
4242 amended by adding Subsection (c) to read as follows:
4343 (c) The commission shall use optical gas imaging in
4444 two-dimensional vertical fields or other technologies that measure
4545 the concentration and volume of emissions of volatile organic
4646 compounds and nitrogen oxides.
4747 SECTION 5. This Act takes effect September 1, 2009.
