No. 4581 A BILL TO BE ENTITLED AN ACT relating to the use of advanced technologies by the Texas Commission on Environmental Quality for measuring and monitoring air pollution. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 382.014, Health and Safety Code, is amended to read as follows: Sec. 382.014. EMISSION INVENTORY. (a) The commission may require a person whose activities cause emissions of air contaminants to submit information to enable the commission to develop an inventory of emissions of air contaminants in this state. (b) The commission shall use emissions information submitted under this section and gathered during other commission activities to evaluate the integrity of emissions factors and the emissions inventory. (c) The commission shall annually assess the information collected under this section and recommend emissions inventory improvement strategies in the report required by Section 5.126, Water Code. SECTION 2. Section 382.016, Health and Safety Code, is amended by adding Subsection (c) to read as follows: (c) The commission may measure and monitor the emissions of air contaminants from a source or from an activity causing or resulting in the emission of air contaminants subject to the commission's jurisdiction. SECTION 3. Section 382.0173, Health and Safety Code, is amended by adding Subsection (h) to read as follows: (h) The commission shall adopt policies to permanently reduce quantifiable surplus emissions that are found through the use of any advanced technologies authorized under this chapter to gain credits for this state's air quality state implementation plan. SECTION 4. Section 382.021, Health and Safety Code, is amended by adding Subsection (c) to read as follows: (c) The commission shall use optical gas imaging in two-dimensional vertical fields or other technologies that measure the concentration and volume of emissions of volatile organic compounds and nitrogen oxides. SECTION 5. This Act takes effect September 1, 2009.
