| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter H, Chapter 2155, Government Code, is | |
| 11 | 11 | amended by adding Section 2155.454 to read as follows: | |
| 12 | 12 | Sec. 2155.454. PREFERENCE FOR CERTAIN PHARMACEUTICAL | |
| 13 | 13 | MANUFACTURERS. A state agency that expends appropriated money to | |
| 14 | 14 | purchase pharmaceutical products may give preference to a | |
| 15 | 15 | manufacturer of pharmaceutical products that voluntarily | |
| 16 | 16 | participates in: | |
| 17 | 17 | (1) the vendor drug program for the Department of | |
| 18 | 18 | State Health Services' Children with Special Health Care Needs | |
| 19 | 19 | Services Program; or | |
| 20 | 20 | (2) the Department of State Health Services' Kidney | |
| 21 | 21 | Health Care Program. | |
| 22 | 22 | SECTION 2. This Act takes effect September 1, 2009. |
