A BILL TO BE ENTITLED
AN ACT
relating to a state purchasing preference for certain
pharmaceutical manufacturers.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter H, Chapter 2155, Government Code, is
amended by adding Section 2155.454 to read as follows:
Sec. 2155.454. PREFERENCE FOR CERTAIN PHARMACEUTICAL
MANUFACTURERS. A state agency that expends appropriated money to
purchase pharmaceutical products may give preference to a
manufacturer of pharmaceutical products that voluntarily
participates in:
(1) the vendor drug program for the Department of
State Health Services' Children with Special Health Care Needs
Services Program; or
(2) the Department of State Health Services' Kidney
Health Care Program.
SECTION 2. This Act takes effect September 1, 2009.
