 A BILL TO BE ENTITLED
 AN ACT
 relating to the ability of certain hospitals to employ physicians.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Subchapter A, Chapter 241, Health and Safety
 Code, is amended by adding Section 241.0051 to read as follows:
 Sec. 241.0051.  EMPLOYMENT OF PHYSICIANS. A hospital
 located in a county with a population of less than 100,000 that
 borders the United Mexican States may employ physicians or other
 health care providers as the hospital considers necessary for the
 efficient operation of the hospital. This section may not be
 construed as authorizing the hospital to supervise or control the
 practice of medicine, as prohibited by Subtitle B, Title 3,
 Occupations Code.
 SECTION 2. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
