| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 209, Property Code, is amended by adding |
|---|
| 13 | 13 | | Section 209.014 to read as follows: |
|---|
| 14 | 14 | | Sec. 209.014. RESTRICTIONS ON CERTAIN CHARGES. A property |
|---|
| 15 | 15 | | owners' association, an agent of the association, a management |
|---|
| 16 | 16 | | company, or an agent of the company may charge an owner only the |
|---|
| 17 | 17 | | actual costs incurred by the association, agent, or company to: |
|---|
| 18 | 18 | | (1) notify an owner of a violation of a restriction, |
|---|
| 19 | 19 | | bylaw, rule, or guideline of the association, other than those that |
|---|
| 20 | 20 | | involve payment of assessments; or |
|---|
| 21 | 21 | | (2) cure a violation of any restriction, bylaw, rule, |
|---|
| 22 | 22 | | or guideline of the association. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2009. |
