A BILL TO BE ENTITLED
AN ACT
relating to restrictions on charges imposed on owners by or on
behalf of certain property owners' associations.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 209, Property Code, is amended by adding
Section 209.014 to read as follows:
Sec. 209.014. RESTRICTIONS ON CERTAIN CHARGES. A property
owners' association, an agent of the association, a management
company, or an agent of the company may charge an owner only the
actual costs incurred by the association, agent, or company to:
(1) notify an owner of a violation of a restriction,
bylaw, rule, or guideline of the association, other than those that
involve payment of assessments; or
(2) cure a violation of any restriction, bylaw, rule,
or guideline of the association.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
