| 7 | 7 | | relating to the powers of the board of port commissioners of the |

| 8 | 8 | | Port of Port Arthur Navigation District of Jefferson County, Texas. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2, Chapter 197, Acts of the 58th |
|---|
| 11 | 11 | | Legislature, Regular Session, 1963, is amended by adding Subsection |
|---|
| 12 | 12 | | (m) to read as follows: |
|---|
| 13 | 13 | | (m) The Board of Port Commissioners has absolute control |
|---|
| 14 | 14 | | over channels or other waterways within the corporate limits of the |
|---|
| 15 | 15 | | district, including turning basins, yacht basins, and storage |
|---|
| 16 | 16 | | basins. The district may prevent or remove any obstructions of |
|---|
| 17 | 17 | | those facilities and may set appropriate fees, charges, and tolls |
|---|
| 18 | 18 | | for their use. The fees, charges, and tolls charged by the district |
|---|
| 19 | 19 | | shall be in addition to charges made, as provided by law, for any |
|---|
| 20 | 20 | | facilities used by any ship, boat, vessel, or any other character of |
|---|
| 21 | 21 | | craft used for water transportation for commercial purposes. For |
|---|
| 22 | 22 | | purposes of this subsection, "commercial purposes" is limited to |
|---|
| 23 | 23 | | any common carrier, contract carrier, or public or private carrier |
|---|
| 24 | 24 | | that transports for hire or compensation persons, commodities, |
|---|
| 25 | 25 | | goods, wares, or merchandise. |
|---|
| 26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2009. |
