55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the powers of the board of port commissioners of the
88 Port of Port Arthur Navigation District of Jefferson County, Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2, Chapter 197, Acts of the 58th
1111 Legislature, Regular Session, 1963, is amended by adding Subsection
1212 (m) to read as follows:
1313 (m) The Board of Port Commissioners has absolute control
1414 over channels or other waterways within the corporate limits of the
1515 district, including turning basins, yacht basins, and storage
1616 basins. The district may prevent or remove any obstructions of
1717 those facilities and may set appropriate fees, charges, and tolls
1818 for their use. The fees, charges, and tolls charged by the district
1919 shall be in addition to charges made, as provided by law, for any
2020 facilities used by any ship, boat, vessel, or any other character of
2121 craft used for water transportation for commercial purposes. For
2222 purposes of this subsection, "commercial purposes" is limited to
2323 any common carrier, contract carrier, or public or private carrier
2424 that transports for hire or compensation persons, commodities,
2525 goods, wares, or merchandise.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2009.
