10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subtitle C, Title 4, Special District Local Laws |
---|
12 | 12 | | Code, is amended by adding Chapter 3874 to read as follows: |
---|
13 | 13 | | CHAPTER 3874. CYPRESS WATERS MUNICIPAL MANAGEMENT DISTRICT |
---|
14 | 14 | | SUBCHAPTER A. GENERAL PROVISIONS |
---|
15 | 15 | | Sec. 3874.001. DEFINITIONS. In this chapter: |
---|
16 | 16 | | (1) "Board" means the district's board of directors. |
---|
17 | 17 | | (2) "City" means the City of Dallas. |
---|
18 | 18 | | (3) "District" means the Cypress Waters Municipal |
---|
19 | 19 | | Management District. |
---|
20 | 20 | | (4) "Improvement project" means a project authorized |
---|
21 | 21 | | by Section 3874.102: |
---|
22 | 22 | | (A) inside the boundaries of the district; and |
---|
23 | 23 | | (B) in areas outside but adjacent to the |
---|
24 | 24 | | boundaries of the district if the project is for the purpose of |
---|
25 | 25 | | extending public infrastructure improvements beyond the district's |
---|
26 | 26 | | boundaries to a logical terminus. |
---|
27 | 27 | | Sec. 3874.002. CREATION AND NATURE OF DISTRICT. The |
---|
28 | 28 | | district is a special district created under Section 59, Article |
---|
29 | 29 | | XVI, Texas Constitution. |
---|
30 | 30 | | Sec. 3874.003. PURPOSE; LEGISLATIVE FINDINGS. (a) The |
---|
31 | 31 | | creation of the district is essential to accomplish the purposes of |
---|
32 | 32 | | Sections 52 and 52-a, Article III, and Section 59, Article XVI, |
---|
33 | 33 | | Texas Constitution, and other public purposes stated in this |
---|
34 | 34 | | chapter. By creating the district and in authorizing the city and |
---|
35 | 35 | | other political subdivisions to contract with the district, the |
---|
36 | 36 | | legislature has established a program to accomplish the public |
---|
37 | 37 | | purposes set out in Section 52-a, Article III, Texas Constitution. |
---|
38 | 38 | | (b) The creation of the district is necessary to promote, |
---|
39 | 39 | | develop, encourage, and maintain employment, commerce, |
---|
40 | 40 | | transportation, housing, tourism, recreation, the arts, |
---|
41 | 41 | | entertainment, economic development, safety, and the public |
---|
42 | 42 | | welfare in the district. |
---|
43 | 43 | | (c) The district is created to supplement and not to |
---|
44 | 44 | | supplant city services provided in the district. |
---|
45 | 45 | | Sec. 3874.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a) |
---|
46 | 46 | | The district is created to serve a public use and benefit. |
---|
47 | 47 | | (b) All land and other property included in the district |
---|
48 | 48 | | will benefit from the improvements and services to be provided by |
---|
49 | 49 | | the district under powers conferred by Sections 52 and 52-a, |
---|
50 | 50 | | Article III, and Section 59, Article XVI, Texas Constitution, and |
---|
51 | 51 | | other powers granted under this chapter. |
---|
52 | 52 | | (c) The creation of the district is in the public interest |
---|
53 | 53 | | and is essential to further the public purposes of: |
---|
54 | 54 | | (1) developing and diversifying the economy of the |
---|
55 | 55 | | state; |
---|
56 | 56 | | (2) eliminating unemployment and underemployment; |
---|
57 | 57 | | (3) developing or expanding transportation and |
---|
58 | 58 | | commerce; and |
---|
59 | 59 | | (4) providing quality residential housing. |
---|
60 | 60 | | (d) The district will: |
---|
61 | 61 | | (1) promote the health, safety, and general welfare of |
---|
62 | 62 | | residents, employers, potential employees, employees, visitors, |
---|
63 | 63 | | and consumers in the district, and of the public; |
---|
64 | 64 | | (2) provide needed funding for the district to |
---|
65 | 65 | | preserve, maintain, and enhance the economic health and vitality of |
---|
66 | 66 | | the district territory as a residential community and business |
---|
67 | 67 | | center; and |
---|
68 | 68 | | (3) promote the health, safety, welfare, and enjoyment |
---|
69 | 69 | | of the public by providing pedestrian ways and by landscaping and |
---|
70 | 70 | | developing certain areas in the district, which are necessary for |
---|
71 | 71 | | the restoration, preservation, and enhancement of scenic beauty. |
---|
72 | 72 | | (e) Pedestrian ways along or across a street, whether at |
---|
73 | 73 | | grade or above or below the surface, and street lighting, street |
---|
74 | 74 | | landscaping, vehicle parking, and street art objects are parts of |
---|
75 | 75 | | and necessary components of a street and are considered to be an |
---|
76 | 76 | | improvement project that includes a street or road improvement. |
---|
77 | 77 | | (f) The district will not act as the agent or |
---|
78 | 78 | | instrumentality of any private interest even though the district |
---|
79 | 79 | | will benefit many private interests as well as the public. |
---|
80 | 80 | | Sec. 3874.005. DISTRICT TERRITORY. (a) The district is |
---|
81 | 81 | | composed of the territory described by Section 2 of the Act enacting |
---|
82 | 82 | | this chapter, as that territory may have been modified under: |
---|
83 | 83 | | (1) Section 3874.106; or |
---|
84 | 84 | | (2) other law. |
---|
85 | 85 | | (b) A mistake in the field notes of the district contained |
---|
86 | 86 | | in Section 2 of the Act enacting this chapter or in copying the |
---|
87 | 87 | | field notes in the legislative process does not in any way affect: |
---|
88 | 88 | | (1) the district's organization, existence, or |
---|
89 | 89 | | validity; |
---|
90 | 90 | | (2) the district's right to contract, including the |
---|
91 | 91 | | right to issue any type of bond or other obligation for a purpose |
---|
92 | 92 | | for which the district is created; |
---|
93 | 93 | | (3) the district's right to impose or collect an |
---|
94 | 94 | | assessment, tax, or any other revenue; or |
---|
95 | 95 | | (4) the legality or operation of the board. |
---|
96 | 96 | | Sec. 3874.006. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES. |
---|
97 | 97 | | (a) All or any part of the area of the district is eligible to be |
---|
98 | 98 | | included in: |
---|
99 | 99 | | (1) a tax increment reinvestment zone created by the |
---|
100 | 100 | | city under Chapter 311, Tax Code; |
---|
101 | 101 | | (2) a tax abatement reinvestment zone created by the |
---|
102 | 102 | | city under Chapter 312, Tax Code; or |
---|
103 | 103 | | (3) an enterprise zone created by the city under |
---|
104 | 104 | | Chapter 2303, Government Code. |
---|
105 | 105 | | (b) If the city creates a tax increment reinvestment zone |
---|
106 | 106 | | described by Subsection (a), the city and the board of directors of |
---|
107 | 107 | | the zone, by contract with the district, may grant money deposited |
---|
108 | 108 | | in the tax increment fund to the district to be used by the district |
---|
109 | 109 | | for the purposes permitted for money granted to a corporation under |
---|
110 | 110 | | Section 380.002(b), Local Government Code, including the right to |
---|
111 | 111 | | pledge the money as security for any bonds issued by the district |
---|
112 | 112 | | for an improvement project. A project may not receive public funds |
---|
113 | 113 | | under Section 380.002(b), Local Government Code, unless the project |
---|
114 | 114 | | has been approved by the governing body of the city by the adoption |
---|
115 | 115 | | of a resolution. |
---|
116 | 116 | | (c) A tax increment reinvestment zone created by the city in |
---|
117 | 117 | | the district is not subject to the limitations provided by Section |
---|
118 | 118 | | 311.006(b), Tax Code. |
---|

---|
120 | 120 | | SUBCHAPTER B. BOARD OF DIRECTORS |
---|
121 | 121 | | Sec. 3874.051. GOVERNING BODY; TERMS. (a) The district is |
---|
122 | 122 | | governed by a board of nine directors composed of: |
---|
123 | 123 | | (1) six directors appointed by the governing body of |
---|
124 | 124 | | the city; |
---|
125 | 125 | | (2) one assistant city manager of the city, appointed |
---|
126 | 126 | | by the city manager; |
---|
127 | 127 | | (3) the chief financial officer of the city; and |
---|
128 | 128 | | (4) the economic director of the city. |
---|
129 | 129 | | (b) Directors serve staggered terms of four years, with four |
---|
130 | 130 | | or five directors' terms expiring July 1 of each odd-numbered year. |
---|
131 | 131 | | Sec. 3874.052. APPOINTMENT OF DIRECTORS: BOARD MEETINGS. |
---|
132 | 132 | | (a) Directors appointed by the governing body of the city must meet |
---|
133 | 133 | | at least one of the qualifications prescribed by Section 3874.053. |
---|
134 | 134 | | (b) A person may not be appointed to the board by the |
---|
135 | 135 | | governing body of the city if the appointment of that person would |
---|
136 | 136 | | result in fewer than three of the directors being residents of the |
---|
137 | 137 | | city and meeting the qualifications prescribed by Section |
---|
138 | 138 | | 3874.053(a)(2), (3), (4), (5), or (6). |
---|
139 | 139 | | (c) The governing body of the city may remove a member of the |
---|
140 | 140 | | board with or without cause at any time by a majority vote. |
---|
141 | 141 | | (d) The board shall hold meetings at a place accessible to |
---|
142 | 142 | | the public. The board shall file a copy of the notice of a meeting |
---|
143 | 143 | | with the city's secretary. The city's secretary shall post the |
---|
144 | 144 | | notice at Dallas City Hall. |
---|
145 | 145 | | (e) The board may not create an executive committee to |
---|
146 | 146 | | exercise the powers of the board. |
---|
147 | 147 | | (f) If an office described in Section 3874.051(a) is |
---|
148 | 148 | | renamed, changed, or abolished, the governing body of the city may |
---|
149 | 149 | | appoint another city officer or employee who performs duties |
---|
150 | 150 | | comparable to those performed by the officer described by that |
---|
151 | 151 | | subsection. |
---|
152 | 152 | | Sec. 3874.053. QUALIFICATIONS OF DIRECTORS APPOINTED BY |
---|
153 | 153 | | CITY. (a) To be qualified to serve as a director appointed by the |
---|
154 | 154 | | governing body of the city, a person must be at least 18 years old |
---|
155 | 155 | | and must be: |
---|
156 | 156 | | (1) a resident of the district who is also a registered |
---|
157 | 157 | | voter of the district; |
---|
158 | 158 | | (2) an owner of property in the district; |
---|
159 | 159 | | (3) an owner of stock or a partnership or membership |
---|
160 | 160 | | interest, whether beneficial or otherwise, of a corporate |
---|
161 | 161 | | partnership, limited liability company, or other entity owner of a |
---|
162 | 162 | | direct or indirect interest in property in the district; |
---|
163 | 163 | | (4) an owner of a beneficial interest in a trust, or a |
---|
164 | 164 | | trustee in a trust, that directly or indirectly owns property in the |
---|
165 | 165 | | district; |
---|
166 | 166 | | (5) an agent, employee, or tenant of a person covered |
---|
167 | 167 | | by Subdivision (2), (3), or (4); or |
---|
168 | 168 | | (6) an initial director. |
---|
169 | 169 | | (b) Section 49.052, Water Code, does not apply to the |
---|
170 | 170 | | district. |
---|
171 | 171 | | Sec. 3874.054. VACANCY. The governing body of the city |
---|
172 | 172 | | shall fill a vacancy on the board by appointing a person who meets |
---|
173 | 173 | | the qualifications prescribed by Section 3874.051(a) or 3874.053 to |
---|
174 | 174 | | serve for the remainder of the unexpired term. |
---|
175 | 175 | | Sec. 3874.055. DIRECTOR'S OATH OR AFFIRMATION. A |
---|
176 | 176 | | director's oath or affirmation of office shall be filed with the |
---|
177 | 177 | | district and the district shall retain the oath or affirmation in |
---|
178 | 178 | | the district records. A copy of each director's oath or affirmation |
---|
179 | 179 | | of office shall be filed with the city's secretary. |
---|
180 | 180 | | Sec. 3874.056. OFFICERS. The board shall elect from among |
---|
181 | 181 | | the directors a chair, a vice chair, and a secretary. The offices |
---|
182 | 182 | | of chair and secretary may not be held by the same person |
---|
183 | 183 | | concurrently. |
---|
184 | 184 | | Sec. 3874.057. COMPENSATION; EXPENSES; LIABILITY INSURANCE |
---|
185 | 185 | | FOR DIRECTORS. (a) The district may compensate each director in an |
---|
186 | 186 | | amount not to exceed $50 for each board meeting. The total amount |
---|
187 | 187 | | of compensation for each director in one year may not exceed $2,000. |
---|
188 | 188 | | (b) Directors are entitled to reimbursement for necessary |
---|
189 | 189 | | and reasonable expenses incurred in carrying out the duties and |
---|
190 | 190 | | responsibilities of the board. |
---|
191 | 191 | | (c) The district may obtain and pay for comprehensive |
---|
192 | 192 | | general liability insurance coverage from a commercial insurance |
---|
193 | 193 | | company or other source that protects and insures a director |
---|
194 | 194 | | against personal liability and from any and all claims relating to: |
---|
195 | 195 | | (1) actions taken by the director in the director's |
---|
196 | 196 | | capacity as a member of the board; |
---|
197 | 197 | | (2) actions and activities taken by the district; or |
---|
198 | 198 | | (3) the actions of others acting on behalf of the |
---|
199 | 199 | | district. |
---|
200 | 200 | | Sec. 3874.058. CONFLICTS OF INTEREST. (a) A director, |
---|
201 | 201 | | including a director who qualifies under Section 3874.053(a)(2), |
---|
202 | 202 | | (3), (4), or (5), may participate in all board votes and decisions |
---|
203 | 203 | | if the director complies with the requirements of Subsection (b). |
---|
204 | 204 | | (b) A director shall comply with Section 171.004, Local |
---|
205 | 205 | | Government Code, including the disclosure and abstention |
---|
206 | 206 | | requirements of that section. A director must file a copy of the |
---|
207 | 207 | | director's disclosure affidavit required by Section 171.004, Local |
---|
208 | 208 | | Government Code, with the city's secretary before participating in |
---|
209 | 209 | | a board discussion or vote. |
---|
210 | 210 | | Sec. 3874.059. INITIAL DIRECTORS. (a) The initial board |
---|
211 | 211 | | consists of the following directors: |
---|
212 | 212 | | (1) Place 1 Lucy Billingsley; |
---|
213 | 213 | | (2) Place 2 Mario Canizares; |
---|
214 | 214 | | (3) Place 3 Sid Grant; |
---|

234 | 234 | | SUBCHAPTER C. POWERS AND DUTIES |
---|
235 | 235 | | Sec. 3874.101. GENERAL POWERS AND DUTIES. The district has |
---|
236 | 236 | | the powers and duties provided by this chapter and by: |
---|
237 | 237 | | (1) the general laws relating to conservation and |
---|
238 | 238 | | reclamation districts created under Section 59, Article XVI, Texas |
---|
239 | 239 | | Constitution, including Chapters 49 and 54, Water Code, except that |
---|
240 | 240 | | the district's bonds and other securities are not subject to the |
---|
241 | 241 | | jurisdiction or supervision of the Texas Commission on |
---|
242 | 242 | | Environmental Quality under Chapter 49, Water Code, or other law; |
---|
243 | 243 | | (2) the general laws relating to road districts and |
---|
244 | 244 | | road utility districts created under Section 52(b), Article III, |
---|
245 | 245 | | Texas Constitution, including Chapter 441, Transportation Code, |
---|
246 | 246 | | except that the district may exercise any power granted by this |
---|
247 | 247 | | chapter without regard to any provision or requirement of or |
---|
248 | 248 | | procedure prescribed by Chapter 441, Transportation Code; |
---|
249 | 249 | | (3) Subchapter A, Chapter 372, Local Government Code, |
---|
250 | 250 | | in the same manner as a municipality or a county; |
---|
251 | 251 | | (4) Chapter 1371, Government Code; |
---|
252 | 252 | | (5) Chapter 375, Local Government Code; and |
---|
253 | 253 | | (6) Chapter 311, Tax Code. |
---|
254 | 254 | | Sec. 3874.102. IMPROVEMENT PROJECTS. (a) The district may |
---|
255 | 255 | | provide, or it may enter into contracts with a governmental or |
---|
256 | 256 | | private entity to provide, the following types of improvement |
---|
257 | 257 | | projects located in the district or activities in support of or |
---|
258 | 258 | | incidental to those projects: |
---|
259 | 259 | | (1) a supply and distribution facility or system to |
---|
260 | 260 | | provide potable and nonpotable water to the residents and |
---|
261 | 261 | | businesses of the district, including a wastewater collection |
---|
262 | 262 | | facility; |
---|
263 | 263 | | (2) a paved, macadamized, or graveled road, street, or |
---|
264 | 264 | | turnpike, inside and outside the district, to the full extent |
---|
265 | 265 | | authorized by Section 52, Article III, Texas Constitution; |
---|
266 | 266 | | (3) the planning, design, construction, improvement, |
---|
267 | 267 | | and maintenance of: |
---|
268 | 268 | | (A) landscaping; |
---|
269 | 269 | | (B) highway right-of-way or transit corridor |
---|
270 | 270 | | beautification and improvement; |
---|
271 | 271 | | (C) lighting, banners, and signs; |
---|
272 | 272 | | (D) a street or sidewalk; |
---|
273 | 273 | | (E) a hiking and cycling path or trail; |
---|
274 | 274 | | (F) a pedestrian walkway, skywalk, crosswalk, or |
---|
275 | 275 | | tunnel; |
---|
276 | 276 | | (G) a park, lake, garden, recreational facility, |
---|
277 | 277 | | community activities center, dock, wharf, sports facility, open |
---|
278 | 278 | | space, scenic area, or related exhibit or preserve; |
---|
279 | 279 | | (H) a fountain, plaza, or pedestrian mall; or |
---|
280 | 280 | | (I) a drainage or storm-water detention |
---|
281 | 281 | | improvement; |
---|
282 | 282 | | (4) protection and improvement of the quality of storm |
---|
283 | 283 | | water that flows through the district; |
---|
284 | 284 | | (5) the planning, design, construction, improvement, |
---|
285 | 285 | | maintenance, and operation of: |
---|
286 | 286 | | (A) a water or sewer facility; or |
---|
287 | 287 | | (B) an off-street parking facility or heliport; |
---|
288 | 288 | | (6) the planning and acquisition of: |
---|
289 | 289 | | (A) public art and sculpture and related exhibits |
---|
290 | 290 | | and facilities; or |
---|
291 | 291 | | (B) an educational facility, and a cultural |
---|
292 | 292 | | exhibit or facility; |
---|
293 | 293 | | (7) the planning, design, construction, acquisition, |
---|
294 | 294 | | lease, rental, improvement, maintenance, installation, and |
---|
295 | 295 | | management of and provision of furnishings for a facility for: |
---|
296 | 296 | | (A) a conference, convention, or exhibition; |
---|
297 | 297 | | (B) a manufacturer, consumer, or trade show; |
---|
298 | 298 | | (C) a civic, community, or institutional event; |
---|
299 | 299 | | or |
---|
300 | 300 | | (D) an exhibit, display, attraction, special |
---|
301 | 301 | | event, or seasonal or cultural celebration or holiday; |
---|
302 | 302 | | (8) the removal, razing, demolition, or clearing of |
---|
303 | 303 | | land or improvements in connection with improvement projects; |
---|
304 | 304 | | (9) the acquisition and improvement of land or other |
---|
305 | 305 | | property for the mitigation of the environmental effects of an |
---|
306 | 306 | | improvement project if those costs are incurred in accordance with |
---|
307 | 307 | | a development agreement and reimbursement of those costs is |
---|
308 | 308 | | conditioned on the completion of substantial vertical development, |
---|
309 | 309 | | or the costs are related to a transit or mobility project; |
---|
310 | 310 | | (10) the acquisition of property or an interest in |
---|
311 | 311 | | property in connection with one or more authorized improvement |
---|
312 | 312 | | projects, including a project authorized by Subchapter A, Chapter |
---|
313 | 313 | | 372, Local Government Code; |
---|
314 | 314 | | (11) a special or supplemental service for the |
---|
315 | 315 | | improvement and promotion of the district or an area adjacent to the |
---|
316 | 316 | | district or for the protection of public health and safety in or |
---|
317 | 317 | | adjacent to the district, including: |
---|
318 | 318 | | (A) advertising; |
---|
319 | 319 | | (B) promotion; |
---|
320 | 320 | | (C) tourism; |
---|
321 | 321 | | (D) health and sanitation; |
---|
322 | 322 | | (E) public safety; |
---|
323 | 323 | | (F) security; |
---|
324 | 324 | | (G) fire protection or emergency medical |
---|
325 | 325 | | services; |
---|
326 | 326 | | (H) business recruitment; |
---|
327 | 327 | | (I) elimination of traffic congestion, including |
---|
328 | 328 | | by use of rail services; and |
---|
329 | 329 | | (J) recreational, educational, or cultural |
---|
330 | 330 | | improvements, enhancements, and services; or |
---|
331 | 331 | | (12) any similar public improvement, facility, or |
---|
332 | 332 | | service. |
---|
333 | 333 | | (b) The district may not undertake an improvement project |
---|
334 | 334 | | under this section unless the board determines the project to be |
---|
335 | 335 | | necessary to accomplish a public purpose of the district and has |
---|
336 | 336 | | received the approval of the city under Section 3874.160. |
---|
337 | 337 | | (c) An improvement project must comply with any applicable |
---|
338 | 338 | | codes and ordinances of the city. |
---|
339 | 339 | | (d) The district may not provide, conduct, or authorize an |
---|
340 | 340 | | improvement project on the city streets, highways, rights-of-way, |
---|
341 | 341 | | or easements without the consent of the governing body of the city. |
---|
342 | 342 | | (e) Subject to an agreement between the district and the |
---|
343 | 343 | | city, the city may: |
---|
344 | 344 | | (1) by ordinance, order, or resolution require that |
---|
345 | 345 | | title to all or any portion of an improvement project vest in the |
---|
346 | 346 | | city; or |
---|
347 | 347 | | (2) unless prohibited by Subsection (h), by ordinance, |
---|
348 | 348 | | order, resolution, or other directive, authorize the district to |
---|
349 | 349 | | own, encumber, maintain, and operate an improvement project, |
---|
350 | 350 | | subject to the right of the city to order a conveyance of the |
---|
351 | 351 | | improvement project to the city on a date determined by the city. |

357 | 357 | | (h) Waterworks and sanitary sewer improvements may be |
---|
358 | 358 | | undertaken by the district inside or outside the boundaries of the |
---|
359 | 359 | | district, subject to the following conditions: |
---|
360 | 360 | | (1) the city shall request that waterworks or sanitary |
---|
361 | 361 | | sewer improvements be funded by the district; |
---|
362 | 362 | | (2) the city shall construct, own, operate, and |
---|
363 | 363 | | maintain the improvements; and |
---|
364 | 364 | | (3) the district shall comply with Sections 3874.152, |
---|
365 | 365 | | 3874.157, and 3874.160 as a condition for the district to fund the |
---|
366 | 366 | | improvements. |
---|
367 | 367 | | Sec. 3874.103. GENERAL POWERS REGARDING CONTRACTS. (a) |
---|
368 | 368 | | The district may: |
---|
369 | 369 | | (1) contract with any person to accomplish any |
---|
370 | 370 | | district purpose, including a contract for: |
---|
371 | 371 | | (A) the payment, repayment, or reimbursement of |
---|
372 | 372 | | costs incurred by that person on behalf of the district, including |
---|
373 | 373 | | all or part of the costs of any improvement project and interest on |
---|
374 | 374 | | the reimbursed cost; or |
---|
375 | 375 | | (B) the use, occupancy, lease, rental, |
---|
376 | 376 | | operation, maintenance, or management of all or part of a proposed |
---|
377 | 377 | | or existing improvement project; and |
---|
378 | 378 | | (2) apply for and contract with any person to receive, |
---|
379 | 379 | | administer, and perform a duty or obligation of the district under a |
---|
380 | 380 | | federal, state, local, or private gift, grant, loan, conveyance, |
---|
381 | 381 | | transfer, bequest, or other financial assistance arrangement |
---|
382 | 382 | | relating to the investigation, planning, analysis, study, design, |
---|
383 | 383 | | acquisition, construction, improvement, completion, |
---|
384 | 384 | | implementation, or operation by the district or others of a |
---|
385 | 385 | | proposed or existing improvement project. |
---|
386 | 386 | | (b) A contract the district enters into to carry out a |
---|
387 | 387 | | purpose of this chapter may be on any terms and for any period the |
---|
388 | 388 | | board determines, including a negotiable or nonnegotiable note or |
---|
389 | 389 | | warrant payable to the city, Dallas County, or any other person. |
---|
390 | 390 | | (c) Any person may contract with the district to carry out |
---|
391 | 391 | | the purposes of this chapter without further statutory or other |
---|
392 | 392 | | authorization. |
---|
393 | 393 | | Sec. 3874.104. RULES; ENFORCEMENT. (a) The district may |
---|
394 | 394 | | adopt rules: |
---|
395 | 395 | | (1) to administer or operate the district; |
---|
396 | 396 | | (2) for the use, enjoyment, availability, protection, |
---|
397 | 397 | | security, and maintenance of the district's property and |
---|
398 | 398 | | facilities; or |
---|
399 | 399 | | (3) to provide for public safety and security in the |
---|
400 | 400 | | district. |
---|
401 | 401 | | (b) The district may enforce its rules by injunctive relief. |
---|
402 | 402 | | (c) To the extent a district rule conflicts with a city |
---|
403 | 403 | | rule, order, or regulation, the city rule, order, or regulation |
---|
404 | 404 | | controls. |
---|
405 | 405 | | (d) The district shall provide the city with written notice |
---|
406 | 406 | | not later than the 30th day before the date of a meeting at which the |
---|
407 | 407 | | board will adopt rules. The district may not adopt a rule affecting |
---|
408 | 408 | | the use of a municipally owned asset, such as a public park, street, |
---|
409 | 409 | | sidewalk, transit facility, or public right-of-way, unless the |
---|
410 | 410 | | governing body of the city has approved the rule by ordinance, |
---|
411 | 411 | | order, or resolution. |
---|
412 | 412 | | Sec. 3874.105. NAME CHANGE. The board by resolution may |
---|
413 | 413 | | change the district's name. The board shall give written notice of |
---|
414 | 414 | | the change to the city. |
---|
415 | 415 | | Sec. 3874.106. ADDING OR REMOVING TERRITORY. The board may |
---|
416 | 416 | | add or remove territory under Subchapter J, Chapter 49, Water Code, |
---|
417 | 417 | | and Section 54.016, Water Code, except that: |
---|
418 | 418 | | (1) the addition or removal of the territory must be |
---|
419 | 419 | | approved by: |
---|
420 | 420 | | (A) the governing body of the city by ordinance, |
---|
421 | 421 | | order, or resolution; and |
---|
422 | 422 | | (B) the owners of the territory being added or |
---|
423 | 423 | | removed; |
---|
424 | 424 | | (2) a reference to a tax in Subchapter J, Chapter 49, |
---|
425 | 425 | | Water Code, or Section 54.016, Water Code, means an ad valorem tax; |
---|
426 | 426 | | and |
---|
427 | 427 | | (3) territory may not be removed from the district if |
---|
428 | 428 | | bonds or other obligations of the district payable wholly or partly |
---|
429 | 429 | | from ad valorem taxes or assessments levied or assessed on the |
---|
430 | 430 | | territory are outstanding. |
---|
431 | 431 | | Sec. 3874.107. ECONOMIC DEVELOPMENT. (a) The district may |
---|
432 | 432 | | create economic development and other programs under Section 52-a, |
---|
433 | 433 | | Article III, Texas Constitution, and may impose and collect ad |
---|
434 | 434 | | valorem taxes for those purposes. The district has the economic |
---|
435 | 435 | | development powers that Chapter 380, Local Government Code, |
---|
436 | 436 | | provides to a municipality with a population of more than 100,000. |
---|
437 | 437 | | Each economic development program and each project that will |
---|
438 | 438 | | receive public funds under an economic development program must be |
---|
439 | 439 | | approved by the governing body of the city by ordinance, order, or |
---|
440 | 440 | | resolution. |
---|
441 | 441 | | (b) The district shall provide the city written notice not |
---|
442 | 442 | | later than the 30th day before the date of a meeting at which the |
---|
443 | 443 | | board will adopt terms of an economic development program. The |
---|
444 | 444 | | district may not adopt an economic development program or |
---|
445 | 445 | | improvement project to be funded under an economic development |
---|
446 | 446 | | program unless the governing body of the city has approved the |
---|
447 | 447 | | program or improvement project by ordinance, order, or resolution. |
---|
448 | 448 | | Sec. 3874.108. NO EMINENT DOMAIN POWER. The district may |
---|
449 | 449 | | not exercise the power of eminent domain. |
---|
450 | 450 | | Sec. 3874.109. TERMS OF EMPLOYMENT; COMPENSATION. The |
---|
451 | 451 | | board may employ and establish the terms of employment and |
---|
452 | 452 | | compensation of an executive director or general manager and any |
---|
453 | 453 | | other district employees the board considers necessary. An |
---|
454 | 454 | | employee may not receive annual compensation of more than $150,000 |
---|
455 | 455 | | from public funds of the district. |
---|
456 | 456 | | Sec. 3874.110. NOTICE TO PROPERTY OWNERS. (a) The board |
---|
457 | 457 | | shall annually provide owners of real property in the district |
---|
458 | 458 | | written notice that specifies the tax of the district for the |
---|
459 | 459 | | district's next fiscal year in sufficient clarity to describe the |
---|
460 | 460 | | tax rate for the operation and maintenance of the district and the |
---|
461 | 461 | | tax rate for the payment of debt service of obligations issued or |
---|
462 | 462 | | incurred by the district. The written notice must be sent by first |
---|
463 | 463 | | class United States mail, postage prepaid, to the current address |
---|
464 | 464 | | of the property owner as reflected on the tax rolls of the appraisal |
---|
465 | 465 | | district. |
---|
466 | 466 | | (b) The notice must clearly state that the tax rates on real |
---|
467 | 467 | | property imposed in the district are in addition to the ad valorem |
---|
468 | 468 | | taxes imposed by other taxing units that tax real property in the |
---|
469 | 469 | | boundaries of the district. |
---|
470 | 470 | | (c) The district shall generate and implement a program to |
---|
471 | 471 | | provide notification to a prospective purchaser of property in the |
---|
472 | 472 | | district of the rates of tax and assessments that have been approved |
---|
473 | 473 | | and are imposed by the district. |
---|

475 | 475 | | SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS |
---|
476 | 476 | | Sec. 3874.151. GENERAL POWERS REGARDING FINANCIAL MATTERS. |
---|
477 | 477 | | (a) Except as provided by Section 3874.160, the district may: |
---|
478 | 478 | | (1) impose an ad valorem tax on all taxable property in |
---|
479 | 479 | | the district to pay for any improvement projects of the types |
---|
480 | 480 | | authorized by Section 52(b), Article III, and Section 59, Article |
---|
481 | 481 | | XVI, Texas Constitution, and to secure the payment of bonds issued |
---|
482 | 482 | | for those purposes; |
---|
483 | 483 | | (2) impose an assessment on property in the district |
---|
484 | 484 | | to pay the cost of any authorized improvement project and the cost |
---|
485 | 485 | | of the maintenance of the project in the manner provided for: |
---|
486 | 486 | | (A) a district under Subchapters A, E, and F, |
---|
487 | 487 | | Chapter 375, Local Government Code; or |
---|
488 | 488 | | (B) a municipality or county under Subchapter A, |
---|
489 | 489 | | Chapter 372, Local Government Code; |
---|
490 | 490 | | (3) provide or secure the payment or repayment of any |
---|
491 | 491 | | bond, note, or other temporary or permanent obligation or |
---|
492 | 492 | | reimbursement or other contract with any person, the costs and |
---|
493 | 493 | | expenses of the establishment, administration, and operation of the |
---|
494 | 494 | | district, and the district's costs or share of the costs or revenue |
---|
495 | 495 | | of an improvement project or district contractual obligation or |
---|
496 | 496 | | indebtedness by or through: |
---|
497 | 497 | | (A) the imposition of an ad valorem tax, |
---|
498 | 498 | | assessment, user fee, concession fee, or rental charge; and |
---|
499 | 499 | | (B) any other revenue or resources of the |
---|
500 | 500 | | district, or other revenue authorized by the city, including |
---|
501 | 501 | | revenue from a tax increment reinvestment zone created by the city |
---|
502 | 502 | | under applicable law; |
---|
503 | 503 | | (4) establish user charges related to the operation of |
---|
504 | 504 | | storm-water facilities, including the regulation of storm water for |
---|
505 | 505 | | the protection of water quality in the district; |
---|
506 | 506 | | (5) establish user charges for the use of nonpotable |
---|
507 | 507 | | water for irrigation purposes, subject to the approval of the |
---|
508 | 508 | | governing body of the city; |
---|
509 | 509 | | (6) undertake separately or jointly with other |
---|
510 | 510 | | persons, including the city or Dallas County, all or part of the |
---|
511 | 511 | | cost of any improvement project, including an improvement project: |
---|
512 | 512 | | (A) for improving, enhancing, and supporting |
---|
513 | 513 | | public safety and security, fire protection and emergency medical |
---|
514 | 514 | | services, and law enforcement in and adjacent to the district; or |
---|
515 | 515 | | (B) that confers a general benefit on the entire |
---|
516 | 516 | | district or a special benefit on a definable part of the district; |
---|
517 | 517 | | and |
---|
518 | 518 | | (7) enter into a tax abatement agreement in accordance |
---|
519 | 519 | | with the general laws of this state authorizing and applicable to |
---|
520 | 520 | | tax abatement agreements by municipalities. |
---|
521 | 521 | | (b) The district may not impose an ad valorem tax to pay for |
---|
522 | 522 | | an improvement project under this chapter unless the imposition is |
---|
523 | 523 | | approved by the voters of the district voting at an election held |
---|
524 | 524 | | for that purpose. The board may call an election to approve the |
---|
525 | 525 | | imposition of an ad valorem tax to pay for an improvement project |
---|
526 | 526 | | under this chapter only if the board receives a petition requesting |
---|
527 | 527 | | the election signed by: |
---|
528 | 528 | | (A) more than 65 percent of the record owners of |
---|
529 | 529 | | real property in the district subject to taxation; or |
---|
530 | 530 | | (B) owners representing more than 65 percent of |
---|
531 | 531 | | the appraised value of real property in the district subject to |
---|
532 | 532 | | taxation, as determined by the tax rolls of the appraisal district. |
---|
533 | 533 | | Sec. 3874.152. BORROWING MONEY. (a) The district may |
---|
534 | 534 | | borrow money for a district purpose by issuing or executing bonds, |
---|
535 | 535 | | notes, credit agreements, or other obligations of any kind found by |
---|
536 | 536 | | the board to be necessary or appropriate for any district purpose. |
---|
537 | 537 | | The bond, note, credit agreement, or other obligation may be |
---|
538 | 538 | | secured by and payable from ad valorem taxes, assessments, a |
---|
539 | 539 | | combination of ad valorem taxes and assessments, or other district |
---|
540 | 540 | | revenue. The governing body of the city must approve the issuance |
---|
541 | 541 | | of bonds, notes, credit agreements, or other obligations of the |
---|
542 | 542 | | district, in general terms before the preparation of preliminary |
---|
543 | 543 | | official statements or loan closing documents, as provided by the |
---|
544 | 544 | | development and operating agreement approved by the city in |
---|
545 | 545 | | accordance with Section 3874.160, or by separate action. |
---|
546 | 546 | | (b) The governing body of the city must approve the final |
---|
547 | 547 | | terms of the bond issuance, note, or credit facility, including the |
---|
548 | 548 | | principal amount, note amount, interest rate or rates, redemption |
---|
549 | 549 | | provisions, and other terms and conditions relating to the |
---|
550 | 550 | | issuance. |
---|
551 | 551 | | (c) The district shall file annual audited financial |
---|
552 | 552 | | statements with the city's secretary. |
---|
553 | 553 | | Sec. 3874.153. ASSESSMENTS; EXEMPTION. (a) The district |
---|
554 | 554 | | may impose an assessment on property in the district, including an |
---|
555 | 555 | | assessment on residential or commercial property, only in the |
---|
556 | 556 | | manner provided by Subchapter A, Chapter 372, Local Government |
---|
557 | 557 | | Code, or Subchapter F, Chapter 375, Local Government Code, for a |
---|
558 | 558 | | municipality, county, or public improvement district, according to |
---|
559 | 559 | | the benefit received by the property. |
---|
560 | 560 | | (b) An assessment on property must be for the limited |
---|
561 | 561 | | purpose of providing capital funding for: |
---|
562 | 562 | | (1) public water and wastewater facilities; |
---|
563 | 563 | | (2) drainage and storm-water facilities; |
---|
564 | 564 | | (3) streets and alleys; and |
---|
565 | 565 | | (4) any authorized project under Chapter 372, Local |
---|
566 | 566 | | Government Code. |
---|
567 | 567 | | (c) An assessment, a reassessment, or an assessment |
---|
568 | 568 | | resulting from an addition to or correction of the assessment roll |
---|
569 | 569 | | by the district, penalties and interest on an assessment or |
---|
570 | 570 | | reassessment, an expense of collection, and reasonable attorney's |
---|
571 | 571 | | fees incurred by the district: |
---|
572 | 572 | | (1) are a first and prior lien against the property |
---|
573 | 573 | | assessed; and |
---|
574 | 574 | | (2) are superior to any other lien or claim other than |
---|
575 | 575 | | a lien or claim for county, school district, or municipal ad valorem |
---|
576 | 576 | | taxes. |
---|
577 | 577 | | (d) A lien of an assessment against property under this |
---|
578 | 578 | | chapter runs with the land, and the portion of an assessment payment |
---|
579 | 579 | | obligation that has not yet come due is not eliminated by the |
---|
580 | 580 | | foreclosure of an ad valorem tax lien. Any purchaser of property in |
---|
581 | 581 | | a foreclosure of an ad valorem tax lien takes the property subject |
---|
582 | 582 | | to the assessment payment obligations that have not yet come due and |
---|
583 | 583 | | to the lien and terms of payment under the applicable assessment |
---|
584 | 584 | | ordinance or order. |
---|
585 | 585 | | (e) The board may make a correction to or deletion from the |
---|
586 | 586 | | assessment roll that does not increase the amount of assessment of |
---|
587 | 587 | | any parcel of land without providing notice and holding a hearing in |
---|
588 | 588 | | the manner required for additional assessments. |
---|
589 | 589 | | (f) The district shall file notice of any tax or assessment |
---|
590 | 590 | | imposed by the district with the county clerk of Dallas County and |
---|
591 | 591 | | post the notice on the district's Internet website. |
---|
592 | 592 | | Sec. 3874.154. RESIDENTIAL PROPERTY EXEMPT. Section |
---|
593 | 593 | | 375.161, Local Government Code, does not apply to the district. |
---|
594 | 594 | | Sec. 3874.155. MAINTENANCE AND OPERATION TAX; ELECTION. |
---|
595 | 595 | | (a) The district may impose a tax for maintenance and operation |
---|
596 | 596 | | purposes, including for: |
---|
597 | 597 | | (1) planning, constructing, acquiring, maintaining, |
---|
598 | 598 | | repairing, and operating all improvement projects, including land, |
---|
599 | 599 | | plants, works, facilities, improvements, appliances, and equipment |
---|
600 | 600 | | of the district; and |
---|
601 | 601 | | (2) paying costs of services, engineering and legal |
---|
602 | 602 | | fees, and organization and administrative expenses, including |
---|
603 | 603 | | expenses of the city payable under the terms of the project |
---|
604 | 604 | | development agreement described by Section 3874.160. |
---|
605 | 605 | | (b) The district may not impose a maintenance and operation |
---|
606 | 606 | | tax for improvement projects under this chapter unless the |
---|
607 | 607 | | imposition of the tax is approved by the voters of the district |
---|
608 | 608 | | voting at an election held for that purpose. An election may be |
---|
609 | 609 | | called only on receipt of a petition as provided by Section |
---|
610 | 610 | | 3874.151(b). |
---|
611 | 611 | | (c) A maintenance and operation tax election may be held at |
---|
612 | 612 | | the same time and in conjunction with any other district election. |
---|
613 | 613 | | The election may be called by a separate election order or as part |
---|
614 | 614 | | of any other election order. |
---|
615 | 615 | | Sec. 3874.156. USE OF SURPLUS MAINTENANCE AND OPERATION |
---|
616 | 616 | | MONEY. If the district has surplus maintenance and operation tax |
---|
617 | 617 | | money that is not needed for the purposes for which it was |
---|
618 | 618 | | collected, the money may be used for any authorized purpose. |
---|
619 | 619 | | Sec. 3874.157. BONDS AND OTHER OBLIGATIONS. (a) Subject to |
---|
620 | 620 | | the requirements of Sections 3874.159 and 3874.160, the district |
---|
621 | 621 | | may issue by public or private sale bonds, notes, or other |
---|
622 | 622 | | obligations payable wholly or partly from ad valorem taxes, or by |
---|
623 | 623 | | assessments in the manner provided by Subchapter A, Chapter 372, |
---|
624 | 624 | | Local Government Code, or Subchapter J, Chapter 375, Local |
---|
625 | 625 | | Government Code. |
---|
626 | 626 | | (b) In exercising the district's borrowing power, the |
---|
627 | 627 | | district may issue a bond or other obligation in the form of a bond, |
---|
628 | 628 | | note, certificate of participation or other instrument evidencing a |
---|
629 | 629 | | proportionate interest in payments to be made by the district, or |
---|
630 | 630 | | any other type of obligation. |
---|
631 | 631 | | (c) In addition to the sources of money described by |
---|
632 | 632 | | Subchapter A, Chapter 372, Local Government Code, and Subchapter J, |
---|
633 | 633 | | Chapter 375, Local Government Code, district bonds may be secured |
---|
634 | 634 | | and made payable wholly or partly by a pledge of any part of the |
---|
635 | 635 | | money the district receives from system or improvement project |
---|
636 | 636 | | revenue or from any other source. |
---|
637 | 637 | | Sec. 3874.158. BOND MATURITY. Bonds may mature not more |
---|
638 | 638 | | than 40 years from their date of issue. |
---|
639 | 639 | | Sec. 3874.159. TAXES FOR BONDS AND OTHER OBLIGATIONS. At |
---|
640 | 640 | | the time bonds or other obligations payable wholly or partly from ad |
---|
641 | 641 | | valorem taxes are issued: |
---|
642 | 642 | | (1) the board shall impose a continuing direct annual |
---|
643 | 643 | | ad valorem tax for each year that all or part of the bonds are |
---|
644 | 644 | | outstanding; and |
---|
645 | 645 | | (2) the district annually shall impose an ad valorem |
---|
646 | 646 | | tax on all taxable property in the district in an amount sufficient |
---|
647 | 647 | | to: |
---|
648 | 648 | | (A) pay the interest on the bonds or other |
---|
649 | 649 | | obligations as the interest becomes due; and |
---|
650 | 650 | | (B) create a sinking fund for the payment of the |
---|
651 | 651 | | principal of the bonds or other obligations when due or the |
---|
652 | 652 | | redemption price at any earlier required redemption date. |
---|
653 | 653 | | Sec. 3874.160. DEVELOPMENT AND OPERATING AGREEMENT |
---|
654 | 654 | | REQUIRED. (a) After the district's board is organized, but before |
---|
655 | 655 | | the district may undertake any improvement project, issue bonds, |
---|
656 | 656 | | impose taxes, levy assessments or fees, or borrow money, the |
---|
657 | 657 | | district and the city must negotiate and execute a mutually |
---|
658 | 658 | | approved and accepted development and operating agreement, |
---|
659 | 659 | | including any limitations imposed by the city, regarding the plans |
---|
660 | 660 | | and rules for: |
---|
661 | 661 | | (1) the exercise of the powers granted to the district |
---|
662 | 662 | | under this chapter, including the organization, development, and |
---|
663 | 663 | | operation of the district; |
---|
664 | 664 | | (2) the selection and description of improvement |
---|
665 | 665 | | projects that may be undertaken and financed by the district and the |
---|
666 | 666 | | ownership, operation, and maintenance of those projects; |
---|
667 | 667 | | (3) the terms, conditions, methods, means, and amounts |
---|
668 | 668 | | of financing authorized by this chapter that the district may use in |
---|
669 | 669 | | providing improvement projects; and |
---|
670 | 670 | | (4) the amounts, methods, and times of reimbursement |
---|
671 | 671 | | to the city for costs and expenses, if any, incurred by the city |
---|
672 | 672 | | with respect to the development and operation of the district and |
---|
673 | 673 | | the financing of improvement projects by the district. |
---|
674 | 674 | | (b) An agreement authorized by this section is not effective |
---|
675 | 675 | | until its terms and execution are approved by the board and the |
---|
676 | 676 | | governing body of the city by resolution. |
---|

678 | 678 | | SUBCHAPTER E. DISSOLUTION |
---|
679 | 679 | | Sec. 3874.251. DISSOLUTION BY CITY ORDINANCE. (a) The city |
---|
680 | 680 | | by ordinance may dissolve the district. |
---|
681 | 681 | | (b) The city may not dissolve the district until the |
---|
682 | 682 | | district's outstanding indebtedness or contractual obligations |
---|
683 | 683 | | that are payable from ad valorem taxes have been repaid or |
---|
684 | 684 | | discharged, or the city has affirmatively assumed the obligation to |
---|
685 | 685 | | pay the outstanding indebtedness from the city's lawfully available |
---|
686 | 686 | | revenue. |
---|
687 | 687 | | (c) The city may not dissolve the district until the |
---|
688 | 688 | | agreement under Section 3874.160 has been executed and the |
---|
689 | 689 | | district's performance under the agreement has been fulfilled, |
---|
690 | 690 | | including any right or obligation the district has to reimburse a |
---|
691 | 691 | | developer or owner for the costs of improvement projects. |
---|
692 | 692 | | Sec. 3874.252. COLLECTION OF ASSESSMENTS AND OTHER REVENUE. |
---|
693 | 693 | | (a) If the dissolved district has bonds or other obligations |
---|
694 | 694 | | outstanding secured by and payable from assessments or other |
---|
695 | 695 | | revenue, other than ad valorem taxes, the city shall succeed to the |
---|
