77 relating to the creation of the Cypress Waters Municipal Management
88 District; providing the authority to impose an assessment, impose a
99 tax, and issue bonds.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1212 Code, is amended by adding Chapter 3874 to read as follows:
1313 CHAPTER 3874. CYPRESS WATERS MUNICIPAL MANAGEMENT DISTRICT
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 3874.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "City" means the City of Dallas.
1818 (3) "District" means the Cypress Waters Municipal
1919 Management District.
2020 (4) "Improvement project" means a project authorized
2121 by Section 3874.102:
2222 (A) inside the boundaries of the district; and
2323 (B) in areas outside but adjacent to the
2424 boundaries of the district if the project is for the purpose of
2525 extending public infrastructure improvements beyond the district's
2626 boundaries to a logical terminus.
2727 Sec. 3874.002. CREATION AND NATURE OF DISTRICT. The
2828 district is a special district created under Section 59, Article
2929 XVI, Texas Constitution.
3030 Sec. 3874.003. PURPOSE; LEGISLATIVE FINDINGS. (a) The
3131 creation of the district is essential to accomplish the purposes of
3232 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
3333 Texas Constitution, and other public purposes stated in this
3434 chapter. By creating the district and in authorizing the city and
3535 other political subdivisions to contract with the district, the
3636 legislature has established a program to accomplish the public
3737 purposes set out in Section 52-a, Article III, Texas Constitution.
3838 (b) The creation of the district is necessary to promote,
3939 develop, encourage, and maintain employment, commerce,
4040 transportation, housing, tourism, recreation, the arts,
4141 entertainment, economic development, safety, and the public
4242 welfare in the district.
4343 (c) The district is created to supplement and not to
4444 supplant city services provided in the district.
4545 Sec. 3874.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a)
4646 The district is created to serve a public use and benefit.
4747 (b) All land and other property included in the district
4848 will benefit from the improvements and services to be provided by
4949 the district under powers conferred by Sections 52 and 52-a,
5050 Article III, and Section 59, Article XVI, Texas Constitution, and
5151 other powers granted under this chapter.
5252 (c) The creation of the district is in the public interest
5353 and is essential to further the public purposes of:
5454 (1) developing and diversifying the economy of the
5555 state;
5656 (2) eliminating unemployment and underemployment;
5757 (3) developing or expanding transportation and
5858 commerce; and
5959 (4) providing quality residential housing.
6060 (d) The district will:
6161 (1) promote the health, safety, and general welfare of
6262 residents, employers, potential employees, employees, visitors,
6363 and consumers in the district, and of the public;
6464 (2) provide needed funding for the district to
6565 preserve, maintain, and enhance the economic health and vitality of
6666 the district territory as a residential community and business
6767 center; and
6868 (3) promote the health, safety, welfare, and enjoyment
6969 of the public by providing pedestrian ways and by landscaping and
7070 developing certain areas in the district, which are necessary for
7171 the restoration, preservation, and enhancement of scenic beauty.
7272 (e) Pedestrian ways along or across a street, whether at
7373 grade or above or below the surface, and street lighting, street
7474 landscaping, vehicle parking, and street art objects are parts of
7575 and necessary components of a street and are considered to be an
7676 improvement project that includes a street or road improvement.
7777 (f) The district will not act as the agent or
7878 instrumentality of any private interest even though the district
7979 will benefit many private interests as well as the public.
8080 Sec. 3874.005. DISTRICT TERRITORY. (a) The district is
8181 composed of the territory described by Section 2 of the Act enacting
8282 this chapter, as that territory may have been modified under:
8383 (1) Section 3874.106; or
8484 (2) other law.
8585 (b) A mistake in the field notes of the district contained
8686 in Section 2 of the Act enacting this chapter or in copying the
8787 field notes in the legislative process does not in any way affect:
8888 (1) the district's organization, existence, or
8989 validity;
9090 (2) the district's right to contract, including the
9191 right to issue any type of bond or other obligation for a purpose
9292 for which the district is created;
9393 (3) the district's right to impose or collect an
9494 assessment, tax, or any other revenue; or
9595 (4) the legality or operation of the board.
9696 Sec. 3874.006. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9797 (a) All or any part of the area of the district is eligible to be
9898 included in:
9999 (1) a tax increment reinvestment zone created by the
100100 city under Chapter 311, Tax Code;
101101 (2) a tax abatement reinvestment zone created by the
102102 city under Chapter 312, Tax Code; or
103103 (3) an enterprise zone created by the city under
104104 Chapter 2303, Government Code.
105105 (b) If the city creates a tax increment reinvestment zone
106106 described by Subsection (a), the city and the board of directors of
107107 the zone, by contract with the district, may grant money deposited
108108 in the tax increment fund to the district to be used by the district
109109 for the purposes permitted for money granted to a corporation under
110110 Section 380.002(b), Local Government Code, including the right to
111111 pledge the money as security for any bonds issued by the district
112112 for an improvement project. A project may not receive public funds
113113 under Section 380.002(b), Local Government Code, unless the project
114114 has been approved by the governing body of the city by the adoption
115115 of a resolution.
116116 (c) A tax increment reinvestment zone created by the city in
117117 the district is not subject to the limitations provided by Section
118118 311.006(b), Tax Code.

120120 SUBCHAPTER B. BOARD OF DIRECTORS
121121 Sec. 3874.051. GOVERNING BODY; TERMS. (a) The district is
122122 governed by a board of nine directors composed of:
123123 (1) six directors appointed by the governing body of
124124 the city;
125125 (2) one assistant city manager of the city, appointed
126126 by the city manager;
127127 (3) the chief financial officer of the city; and
128128 (4) the economic director of the city.
129129 (b) Directors serve staggered terms of four years, with four
130130 or five directors' terms expiring July 1 of each odd-numbered year.
131131 Sec. 3874.052. APPOINTMENT OF DIRECTORS: BOARD MEETINGS.
132132 (a) Directors appointed by the governing body of the city must meet
133133 at least one of the qualifications prescribed by Section 3874.053.
134134 (b) A person may not be appointed to the board by the
135135 governing body of the city if the appointment of that person would
136136 result in fewer than three of the directors being residents of the
137137 city and meeting the qualifications prescribed by Section
138138 3874.053(a)(2), (3), (4), (5), or (6).
139139 (c) The governing body of the city may remove a member of the
140140 board with or without cause at any time by a majority vote.
141141 (d) The board shall hold meetings at a place accessible to
142142 the public. The board shall file a copy of the notice of a meeting
143143 with the city's secretary. The city's secretary shall post the
144144 notice at Dallas City Hall.
145145 (e) The board may not create an executive committee to
146146 exercise the powers of the board.
147147 (f) If an office described in Section 3874.051(a) is
148148 renamed, changed, or abolished, the governing body of the city may
149149 appoint another city officer or employee who performs duties
150150 comparable to those performed by the officer described by that
151151 subsection.
152152 Sec. 3874.053. QUALIFICATIONS OF DIRECTORS APPOINTED BY
153153 CITY. (a) To be qualified to serve as a director appointed by the
154154 governing body of the city, a person must be at least 18 years old
155155 and must be:
156156 (1) a resident of the district who is also a registered
157157 voter of the district;
158158 (2) an owner of property in the district;
159159 (3) an owner of stock or a partnership or membership
160160 interest, whether beneficial or otherwise, of a corporate
161161 partnership, limited liability company, or other entity owner of a
162162 direct or indirect interest in property in the district;
163163 (4) an owner of a beneficial interest in a trust, or a
164164 trustee in a trust, that directly or indirectly owns property in the
165165 district;
166166 (5) an agent, employee, or tenant of a person covered
167167 by Subdivision (2), (3), or (4); or
168168 (6) an initial director.
169169 (b) Section 49.052, Water Code, does not apply to the
170170 district.
171171 Sec. 3874.054. VACANCY. The governing body of the city
172172 shall fill a vacancy on the board by appointing a person who meets
173173 the qualifications prescribed by Section 3874.051(a) or 3874.053 to
174174 serve for the remainder of the unexpired term.
175175 Sec. 3874.055. DIRECTOR'S OATH OR AFFIRMATION. A
176176 director's oath or affirmation of office shall be filed with the
177177 district and the district shall retain the oath or affirmation in
178178 the district records. A copy of each director's oath or affirmation
179179 of office shall be filed with the city's secretary.
180180 Sec. 3874.056. OFFICERS. The board shall elect from among
181181 the directors a chair, a vice chair, and a secretary. The offices
182182 of chair and secretary may not be held by the same person
183183 concurrently.
184184 Sec. 3874.057. COMPENSATION; EXPENSES; LIABILITY INSURANCE
185185 FOR DIRECTORS. (a) The district may compensate each director in an
186186 amount not to exceed $50 for each board meeting. The total amount
187187 of compensation for each director in one year may not exceed $2,000.
188188 (b) Directors are entitled to reimbursement for necessary
189189 and reasonable expenses incurred in carrying out the duties and
190190 responsibilities of the board.
191191 (c) The district may obtain and pay for comprehensive
192192 general liability insurance coverage from a commercial insurance
193193 company or other source that protects and insures a director
194194 against personal liability and from any and all claims relating to:
195195 (1) actions taken by the director in the director's
196196 capacity as a member of the board;
197197 (2) actions and activities taken by the district; or
198198 (3) the actions of others acting on behalf of the
199199 district.
200200 Sec. 3874.058. CONFLICTS OF INTEREST. (a) A director,
201201 including a director who qualifies under Section 3874.053(a)(2),
202202 (3), (4), or (5), may participate in all board votes and decisions
203203 if the director complies with the requirements of Subsection (b).
204204 (b) A director shall comply with Section 171.004, Local
205205 Government Code, including the disclosure and abstention
206206 requirements of that section. A director must file a copy of the
207207 director's disclosure affidavit required by Section 171.004, Local
208208 Government Code, with the city's secretary before participating in
209209 a board discussion or vote.
210210 Sec. 3874.059. INITIAL DIRECTORS. (a) The initial board
211211 consists of the following directors:
212212 (1) Place 1 Lucy Billingsley;
213213 (2) Place 2 Mario Canizares;
214214 (3) Place 3 Sid Grant;
215215 (4) Place 4 Joel Overton, Jr.;
216216 (5) Place 5 Henry Billingsley;
217217 (6) Place 6 Lucilo Pena;
218218 (7) Place 7 City of Dallas Assistant City Manager
219219 A. C. Gonzalez;
220220 (8) Place 8 City of Dallas Chief Financial Officer
221221 David Cook; and
222222 (9) Place 9 City of Dallas Office of Economic
223223 Development Director Karl Zavitkovsky.
224224 (b) The terms of the initial directors expire on the 180th
225225 day after the date on which the Act enacting this chapter takes
226226 effect.
227227 (c) The terms of the directors appointed to succeed the
228228 initial directors appointed for places 1, 2, 3, and 4 expire July 1,
229229 2011, and the terms of the directors appointed to succeed the
230230 initial directors appointed for places 5, 6, 7, 8, and 9 expire July
231231 1, 2013.
232232 (d) This section expires December 31, 2009.

234234 SUBCHAPTER C. POWERS AND DUTIES
235235 Sec. 3874.101. GENERAL POWERS AND DUTIES. The district has
236236 the powers and duties provided by this chapter and by:
237237 (1) the general laws relating to conservation and
238238 reclamation districts created under Section 59, Article XVI, Texas
239239 Constitution, including Chapters 49 and 54, Water Code, except that
240240 the district's bonds and other securities are not subject to the
241241 jurisdiction or supervision of the Texas Commission on
242242 Environmental Quality under Chapter 49, Water Code, or other law;
243243 (2) the general laws relating to road districts and
244244 road utility districts created under Section 52(b), Article III,
245245 Texas Constitution, including Chapter 441, Transportation Code,
246246 except that the district may exercise any power granted by this
247247 chapter without regard to any provision or requirement of or
248248 procedure prescribed by Chapter 441, Transportation Code;
249249 (3) Subchapter A, Chapter 372, Local Government Code,
250250 in the same manner as a municipality or a county;
251251 (4) Chapter 1371, Government Code;
252252 (5) Chapter 375, Local Government Code; and
253253 (6) Chapter 311, Tax Code.
254254 Sec. 3874.102. IMPROVEMENT PROJECTS. (a) The district may
255255 provide, or it may enter into contracts with a governmental or
256256 private entity to provide, the following types of improvement
257257 projects located in the district or activities in support of or
258258 incidental to those projects:
259259 (1) a supply and distribution facility or system to
260260 provide potable and nonpotable water to the residents and
261261 businesses of the district, including a wastewater collection
262262 facility;
263263 (2) a paved, macadamized, or graveled road, street, or
264264 turnpike, inside and outside the district, to the full extent
265265 authorized by Section 52, Article III, Texas Constitution;
266266 (3) the planning, design, construction, improvement,
267267 and maintenance of:
268268 (A) landscaping;
269269 (B) highway right-of-way or transit corridor
270270 beautification and improvement;
271271 (C) lighting, banners, and signs;
272272 (D) a street or sidewalk;
273273 (E) a hiking and cycling path or trail;
274274 (F) a pedestrian walkway, skywalk, crosswalk, or
275275 tunnel;
276276 (G) a park, lake, garden, recreational facility,
277277 community activities center, dock, wharf, sports facility, open
278278 space, scenic area, or related exhibit or preserve;
279279 (H) a fountain, plaza, or pedestrian mall; or
280280 (I) a drainage or storm-water detention
281281 improvement;
282282 (4) protection and improvement of the quality of storm
283283 water that flows through the district;
284284 (5) the planning, design, construction, improvement,
285285 maintenance, and operation of:
286286 (A) a water or sewer facility; or
287287 (B) an off-street parking facility or heliport;
288288 (6) the planning and acquisition of:
289289 (A) public art and sculpture and related exhibits
290290 and facilities; or
291291 (B) an educational facility, and a cultural
292292 exhibit or facility;
293293 (7) the planning, design, construction, acquisition,
294294 lease, rental, improvement, maintenance, installation, and
295295 management of and provision of furnishings for a facility for:
296296 (A) a conference, convention, or exhibition;
297297 (B) a manufacturer, consumer, or trade show;
298298 (C) a civic, community, or institutional event;
299299 or
300300 (D) an exhibit, display, attraction, special
301301 event, or seasonal or cultural celebration or holiday;
302302 (8) the removal, razing, demolition, or clearing of
303303 land or improvements in connection with improvement projects;
304304 (9) the acquisition and improvement of land or other
305305 property for the mitigation of the environmental effects of an
306306 improvement project if those costs are incurred in accordance with
307307 a development agreement and reimbursement of those costs is
308308 conditioned on the completion of substantial vertical development,
309309 or the costs are related to a transit or mobility project;
310310 (10) the acquisition of property or an interest in
311311 property in connection with one or more authorized improvement
312312 projects, including a project authorized by Subchapter A, Chapter
313313 372, Local Government Code;
314314 (11) a special or supplemental service for the
315315 improvement and promotion of the district or an area adjacent to the
316316 district or for the protection of public health and safety in or
317317 adjacent to the district, including:
318318 (A) advertising;
319319 (B) promotion;
320320 (C) tourism;
321321 (D) health and sanitation;
322322 (E) public safety;
323323 (F) security;
324324 (G) fire protection or emergency medical
325325 services;
326326 (H) business recruitment;
327327 (I) elimination of traffic congestion, including
328328 by use of rail services; and
329329 (J) recreational, educational, or cultural
330330 improvements, enhancements, and services; or
331331 (12) any similar public improvement, facility, or
332332 service.
333333 (b) The district may not undertake an improvement project
334334 under this section unless the board determines the project to be
335335 necessary to accomplish a public purpose of the district and has
336336 received the approval of the city under Section 3874.160.
337337 (c) An improvement project must comply with any applicable
338338 codes and ordinances of the city.
339339 (d) The district may not provide, conduct, or authorize an
340340 improvement project on the city streets, highways, rights-of-way,
341341 or easements without the consent of the governing body of the city.
342342 (e) Subject to an agreement between the district and the
343343 city, the city may:
344344 (1) by ordinance, order, or resolution require that
345345 title to all or any portion of an improvement project vest in the
346346 city; or
347347 (2) unless prohibited by Subsection (h), by ordinance,
348348 order, resolution, or other directive, authorize the district to
349349 own, encumber, maintain, and operate an improvement project,
350350 subject to the right of the city to order a conveyance of the
351351 improvement project to the city on a date determined by the city.
352352 (f) The district shall immediately comply with any city
353353 ordinance, order, or resolution adopted under Subsection (e).
354354 (g) For the purposes of this section, planning, design,
355355 construction, improvement, and maintenance of a lake includes work
356356 done for drainage, reclamation, or recreation.
357357 (h) Waterworks and sanitary sewer improvements may be
358358 undertaken by the district inside or outside the boundaries of the
359359 district, subject to the following conditions:
360360 (1) the city shall request that waterworks or sanitary
361361 sewer improvements be funded by the district;
362362 (2) the city shall construct, own, operate, and
363363 maintain the improvements; and
364364 (3) the district shall comply with Sections 3874.152,
365365 3874.157, and 3874.160 as a condition for the district to fund the
366366 improvements.
367367 Sec. 3874.103. GENERAL POWERS REGARDING CONTRACTS. (a)
368368 The district may:
369369 (1) contract with any person to accomplish any
370370 district purpose, including a contract for:
371371 (A) the payment, repayment, or reimbursement of
372372 costs incurred by that person on behalf of the district, including
373373 all or part of the costs of any improvement project and interest on
374374 the reimbursed cost; or
375375 (B) the use, occupancy, lease, rental,
376376 operation, maintenance, or management of all or part of a proposed
377377 or existing improvement project; and
378378 (2) apply for and contract with any person to receive,
379379 administer, and perform a duty or obligation of the district under a
380380 federal, state, local, or private gift, grant, loan, conveyance,
381381 transfer, bequest, or other financial assistance arrangement
382382 relating to the investigation, planning, analysis, study, design,
383383 acquisition, construction, improvement, completion,
384384 implementation, or operation by the district or others of a
385385 proposed or existing improvement project.
386386 (b) A contract the district enters into to carry out a
387387 purpose of this chapter may be on any terms and for any period the
388388 board determines, including a negotiable or nonnegotiable note or
389389 warrant payable to the city, Dallas County, or any other person.
390390 (c) Any person may contract with the district to carry out
391391 the purposes of this chapter without further statutory or other
392392 authorization.
393393 Sec. 3874.104. RULES; ENFORCEMENT. (a) The district may
394394 adopt rules:
395395 (1) to administer or operate the district;
396396 (2) for the use, enjoyment, availability, protection,
397397 security, and maintenance of the district's property and
398398 facilities; or
399399 (3) to provide for public safety and security in the
400400 district.
401401 (b) The district may enforce its rules by injunctive relief.
402402 (c) To the extent a district rule conflicts with a city
403403 rule, order, or regulation, the city rule, order, or regulation
404404 controls.
405405 (d) The district shall provide the city with written notice
406406 not later than the 30th day before the date of a meeting at which the
407407 board will adopt rules. The district may not adopt a rule affecting
408408 the use of a municipally owned asset, such as a public park, street,
409409 sidewalk, transit facility, or public right-of-way, unless the
410410 governing body of the city has approved the rule by ordinance,
411411 order, or resolution.
412412 Sec. 3874.105. NAME CHANGE. The board by resolution may
413413 change the district's name. The board shall give written notice of
414414 the change to the city.
415415 Sec. 3874.106. ADDING OR REMOVING TERRITORY. The board may
416416 add or remove territory under Subchapter J, Chapter 49, Water Code,
417417 and Section 54.016, Water Code, except that:
418418 (1) the addition or removal of the territory must be
419419 approved by:
420420 (A) the governing body of the city by ordinance,
421421 order, or resolution; and
422422 (B) the owners of the territory being added or
423423 removed;
424424 (2) a reference to a tax in Subchapter J, Chapter 49,
425425 Water Code, or Section 54.016, Water Code, means an ad valorem tax;
426426 and
427427 (3) territory may not be removed from the district if
428428 bonds or other obligations of the district payable wholly or partly
429429 from ad valorem taxes or assessments levied or assessed on the
430430 territory are outstanding.
431431 Sec. 3874.107. ECONOMIC DEVELOPMENT. (a) The district may
432432 create economic development and other programs under Section 52-a,
433433 Article III, Texas Constitution, and may impose and collect ad
434434 valorem taxes for those purposes. The district has the economic
435435 development powers that Chapter 380, Local Government Code,
436436 provides to a municipality with a population of more than 100,000.
437437 Each economic development program and each project that will
438438 receive public funds under an economic development program must be
439439 approved by the governing body of the city by ordinance, order, or
440440 resolution.
441441 (b) The district shall provide the city written notice not
442442 later than the 30th day before the date of a meeting at which the
443443 board will adopt terms of an economic development program. The
444444 district may not adopt an economic development program or
445445 improvement project to be funded under an economic development
446446 program unless the governing body of the city has approved the
447447 program or improvement project by ordinance, order, or resolution.
448448 Sec. 3874.108. NO EMINENT DOMAIN POWER. The district may
449449 not exercise the power of eminent domain.
450450 Sec. 3874.109. TERMS OF EMPLOYMENT; COMPENSATION. The
451451 board may employ and establish the terms of employment and
452452 compensation of an executive director or general manager and any
453453 other district employees the board considers necessary. An
454454 employee may not receive annual compensation of more than $150,000
455455 from public funds of the district.
456456 Sec. 3874.110. NOTICE TO PROPERTY OWNERS. (a) The board
457457 shall annually provide owners of real property in the district
458458 written notice that specifies the tax of the district for the
459459 district's next fiscal year in sufficient clarity to describe the
460460 tax rate for the operation and maintenance of the district and the
461461 tax rate for the payment of debt service of obligations issued or
462462 incurred by the district. The written notice must be sent by first
463463 class United States mail, postage prepaid, to the current address
464464 of the property owner as reflected on the tax rolls of the appraisal
465465 district.
466466 (b) The notice must clearly state that the tax rates on real
467467 property imposed in the district are in addition to the ad valorem
468468 taxes imposed by other taxing units that tax real property in the
469469 boundaries of the district.
470470 (c) The district shall generate and implement a program to
471471 provide notification to a prospective purchaser of property in the
472472 district of the rates of tax and assessments that have been approved
473473 and are imposed by the district.

475475 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
476476 Sec. 3874.151. GENERAL POWERS REGARDING FINANCIAL MATTERS.
477477 (a) Except as provided by Section 3874.160, the district may:
478478 (1) impose an ad valorem tax on all taxable property in
479479 the district to pay for any improvement projects of the types
480480 authorized by Section 52(b), Article III, and Section 59, Article
481481 XVI, Texas Constitution, and to secure the payment of bonds issued
482482 for those purposes;
483483 (2) impose an assessment on property in the district
484484 to pay the cost of any authorized improvement project and the cost
485485 of the maintenance of the project in the manner provided for:
486486 (A) a district under Subchapters A, E, and F,
487487 Chapter 375, Local Government Code; or
488488 (B) a municipality or county under Subchapter A,
489489 Chapter 372, Local Government Code;
490490 (3) provide or secure the payment or repayment of any
491491 bond, note, or other temporary or permanent obligation or
492492 reimbursement or other contract with any person, the costs and
493493 expenses of the establishment, administration, and operation of the
494494 district, and the district's costs or share of the costs or revenue
495495 of an improvement project or district contractual obligation or
496496 indebtedness by or through:
497497 (A) the imposition of an ad valorem tax,
498498 assessment, user fee, concession fee, or rental charge; and
499499 (B) any other revenue or resources of the
500500 district, or other revenue authorized by the city, including
501501 revenue from a tax increment reinvestment zone created by the city
502502 under applicable law;
503503 (4) establish user charges related to the operation of
504504 storm-water facilities, including the regulation of storm water for
505505 the protection of water quality in the district;
506506 (5) establish user charges for the use of nonpotable
507507 water for irrigation purposes, subject to the approval of the
508508 governing body of the city;
509509 (6) undertake separately or jointly with other
510510 persons, including the city or Dallas County, all or part of the
511511 cost of any improvement project, including an improvement project:
512512 (A) for improving, enhancing, and supporting
513513 public safety and security, fire protection and emergency medical
514514 services, and law enforcement in and adjacent to the district; or
515515 (B) that confers a general benefit on the entire
516516 district or a special benefit on a definable part of the district;
517517 and
518518 (7) enter into a tax abatement agreement in accordance
519519 with the general laws of this state authorizing and applicable to
520520 tax abatement agreements by municipalities.
521521 (b) The district may not impose an ad valorem tax to pay for
522522 an improvement project under this chapter unless the imposition is
523523 approved by the voters of the district voting at an election held
524524 for that purpose. The board may call an election to approve the
525525 imposition of an ad valorem tax to pay for an improvement project
526526 under this chapter only if the board receives a petition requesting
527527 the election signed by:
528528 (A) more than 65 percent of the record owners of
529529 real property in the district subject to taxation; or
530530 (B) owners representing more than 65 percent of
531531 the appraised value of real property in the district subject to
532532 taxation, as determined by the tax rolls of the appraisal district.
533533 Sec. 3874.152. BORROWING MONEY. (a) The district may
534534 borrow money for a district purpose by issuing or executing bonds,
535535 notes, credit agreements, or other obligations of any kind found by
536536 the board to be necessary or appropriate for any district purpose.
537537 The bond, note, credit agreement, or other obligation may be
538538 secured by and payable from ad valorem taxes, assessments, a
539539 combination of ad valorem taxes and assessments, or other district
540540 revenue. The governing body of the city must approve the issuance
541541 of bonds, notes, credit agreements, or other obligations of the
542542 district, in general terms before the preparation of preliminary
543543 official statements or loan closing documents, as provided by the
544544 development and operating agreement approved by the city in
545545 accordance with Section 3874.160, or by separate action.
546546 (b) The governing body of the city must approve the final
547547 terms of the bond issuance, note, or credit facility, including the
548548 principal amount, note amount, interest rate or rates, redemption
549549 provisions, and other terms and conditions relating to the
550550 issuance.
551551 (c) The district shall file annual audited financial
552552 statements with the city's secretary.
553553 Sec. 3874.153. ASSESSMENTS; EXEMPTION. (a) The district
554554 may impose an assessment on property in the district, including an
555555 assessment on residential or commercial property, only in the
556556 manner provided by Subchapter A, Chapter 372, Local Government
557557 Code, or Subchapter F, Chapter 375, Local Government Code, for a
558558 municipality, county, or public improvement district, according to
559559 the benefit received by the property.
560560 (b) An assessment on property must be for the limited
561561 purpose of providing capital funding for:
562562 (1) public water and wastewater facilities;
563563 (2) drainage and storm-water facilities;
564564 (3) streets and alleys; and
565565 (4) any authorized project under Chapter 372, Local
566566 Government Code.
567567 (c) An assessment, a reassessment, or an assessment
568568 resulting from an addition to or correction of the assessment roll
569569 by the district, penalties and interest on an assessment or
570570 reassessment, an expense of collection, and reasonable attorney's
571571 fees incurred by the district:
572572 (1) are a first and prior lien against the property
573573 assessed; and
574574 (2) are superior to any other lien or claim other than
575575 a lien or claim for county, school district, or municipal ad valorem
576576 taxes.
577577 (d) A lien of an assessment against property under this
578578 chapter runs with the land, and the portion of an assessment payment
579579 obligation that has not yet come due is not eliminated by the
580580 foreclosure of an ad valorem tax lien. Any purchaser of property in
581581 a foreclosure of an ad valorem tax lien takes the property subject
582582 to the assessment payment obligations that have not yet come due and
583583 to the lien and terms of payment under the applicable assessment
584584 ordinance or order.
585585 (e) The board may make a correction to or deletion from the
586586 assessment roll that does not increase the amount of assessment of
587587 any parcel of land without providing notice and holding a hearing in
588588 the manner required for additional assessments.
589589 (f) The district shall file notice of any tax or assessment
590590 imposed by the district with the county clerk of Dallas County and
591591 post the notice on the district's Internet website.
592592 Sec. 3874.154. RESIDENTIAL PROPERTY EXEMPT. Section
593593 375.161, Local Government Code, does not apply to the district.
594594 Sec. 3874.155. MAINTENANCE AND OPERATION TAX; ELECTION.
595595 (a) The district may impose a tax for maintenance and operation
596596 purposes, including for:
597597 (1) planning, constructing, acquiring, maintaining,
598598 repairing, and operating all improvement projects, including land,
599599 plants, works, facilities, improvements, appliances, and equipment
600600 of the district; and
601601 (2) paying costs of services, engineering and legal
602602 fees, and organization and administrative expenses, including
603603 expenses of the city payable under the terms of the project
604604 development agreement described by Section 3874.160.
605605 (b) The district may not impose a maintenance and operation
606606 tax for improvement projects under this chapter unless the
607607 imposition of the tax is approved by the voters of the district
608608 voting at an election held for that purpose. An election may be
609609 called only on receipt of a petition as provided by Section
610610 3874.151(b).
611611 (c) A maintenance and operation tax election may be held at
612612 the same time and in conjunction with any other district election.
613613 The election may be called by a separate election order or as part
614614 of any other election order.
615615 Sec. 3874.156. USE OF SURPLUS MAINTENANCE AND OPERATION
616616 MONEY. If the district has surplus maintenance and operation tax
617617 money that is not needed for the purposes for which it was
618618 collected, the money may be used for any authorized purpose.
619619 Sec. 3874.157. BONDS AND OTHER OBLIGATIONS. (a) Subject to
620620 the requirements of Sections 3874.159 and 3874.160, the district
621621 may issue by public or private sale bonds, notes, or other
622622 obligations payable wholly or partly from ad valorem taxes, or by
623623 assessments in the manner provided by Subchapter A, Chapter 372,
624624 Local Government Code, or Subchapter J, Chapter 375, Local
625625 Government Code.
626626 (b) In exercising the district's borrowing power, the
627627 district may issue a bond or other obligation in the form of a bond,
628628 note, certificate of participation or other instrument evidencing a
629629 proportionate interest in payments to be made by the district, or
630630 any other type of obligation.
631631 (c) In addition to the sources of money described by
632632 Subchapter A, Chapter 372, Local Government Code, and Subchapter J,
633633 Chapter 375, Local Government Code, district bonds may be secured
634634 and made payable wholly or partly by a pledge of any part of the
635635 money the district receives from system or improvement project
636636 revenue or from any other source.
637637 Sec. 3874.158. BOND MATURITY. Bonds may mature not more
638638 than 40 years from their date of issue.
639639 Sec. 3874.159. TAXES FOR BONDS AND OTHER OBLIGATIONS. At
640640 the time bonds or other obligations payable wholly or partly from ad
641641 valorem taxes are issued:
642642 (1) the board shall impose a continuing direct annual
643643 ad valorem tax for each year that all or part of the bonds are
644644 outstanding; and
645645 (2) the district annually shall impose an ad valorem
646646 tax on all taxable property in the district in an amount sufficient
647647 to:
648648 (A) pay the interest on the bonds or other
649649 obligations as the interest becomes due; and
650650 (B) create a sinking fund for the payment of the
651651 principal of the bonds or other obligations when due or the
652652 redemption price at any earlier required redemption date.
653653 Sec. 3874.160. DEVELOPMENT AND OPERATING AGREEMENT
654654 REQUIRED. (a) After the district's board is organized, but before
655655 the district may undertake any improvement project, issue bonds,
656656 impose taxes, levy assessments or fees, or borrow money, the
657657 district and the city must negotiate and execute a mutually
658658 approved and accepted development and operating agreement,
659659 including any limitations imposed by the city, regarding the plans
660660 and rules for:
661661 (1) the exercise of the powers granted to the district
662662 under this chapter, including the organization, development, and
663663 operation of the district;
664664 (2) the selection and description of improvement
665665 projects that may be undertaken and financed by the district and the
666666 ownership, operation, and maintenance of those projects;
667667 (3) the terms, conditions, methods, means, and amounts
668668 of financing authorized by this chapter that the district may use in
669669 providing improvement projects; and
670670 (4) the amounts, methods, and times of reimbursement
671671 to the city for costs and expenses, if any, incurred by the city
672672 with respect to the development and operation of the district and
673673 the financing of improvement projects by the district.
674674 (b) An agreement authorized by this section is not effective
675675 until its terms and execution are approved by the board and the
676676 governing body of the city by resolution.

678678 SUBCHAPTER E. DISSOLUTION
679679 Sec. 3874.251. DISSOLUTION BY CITY ORDINANCE. (a) The city
680680 by ordinance may dissolve the district.
681681 (b) The city may not dissolve the district until the
682682 district's outstanding indebtedness or contractual obligations
683683 that are payable from ad valorem taxes have been repaid or
684684 discharged, or the city has affirmatively assumed the obligation to
685685 pay the outstanding indebtedness from the city's lawfully available
686686 revenue.
687687 (c) The city may not dissolve the district until the
688688 agreement under Section 3874.160 has been executed and the
689689 district's performance under the agreement has been fulfilled,
690690 including any right or obligation the district has to reimburse a
691691 developer or owner for the costs of improvement projects.
692692 Sec. 3874.252. COLLECTION OF ASSESSMENTS AND OTHER REVENUE.
693693 (a) If the dissolved district has bonds or other obligations
694694 outstanding secured by and payable from assessments or other
695695 revenue, other than ad valorem taxes, the city shall succeed to the
696696 rights and obligations of the district regarding enforcement and
697697 collection of the assessments or other revenue.
698698 (b) The city shall have and exercise all district powers to
699699 enforce and collect the assessments or other revenue to pay:
700700 (1) the bonds or other obligations when due and
701701 payable according to their terms; or
702702 (2) special revenue or assessment bonds or other
703703 obligations issued by the city to refund the outstanding bonds or
704704 obligations.
705705 Sec. 3874.253. CONCURRENCE ON ADDITIONAL POWERS. If the
706706 legislature grants the district a power that is in addition to the
707707 powers approved by the initial resolution of the governing body of
708708 the city consenting to the creation of the district, the district
709709 may not exercise that power unless the governing body of the city
710710 consents to that change by resolution.
711711 Sec. 3874.254. ASSUMPTION OF ASSETS AND LIABILITIES. (a)
712712 After the city dissolves the district, the city assumes, subject to
713713 the appropriation and availability of funds, the obligations of the
714714 district, including any bonds or other indebtedness payable from
715715 assessments or other district revenue.
716716 (b) If the city dissolves the district, the board shall
717717 transfer ownership of all district property to the city.

14031403 THENCE North 0034'34" West, a distance of 99.87 feet, to the
14041404 POINT OF BEGINNING, and containing 6.22 acres (270,922 square feet)

14061406 SECTION 3. (a) The legal notice of the intention to
14071407 introduce this Act, setting forth the general substance of this
14081408 Act, has been published as provided by law, and the notice and a
14091409 copy of this Act have been furnished to all persons, agencies,
14101410 officials, or entities to which they are required to be furnished
14111411 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
14121412 Government Code.
14131413 (b) The governor, one of the required recipients, has
14141414 submitted the notice and Act to the Texas Commission on
14151415 Environmental Quality.
14161416 (c) The Texas Commission on Environmental Quality has filed
14171417 its recommendations relating to this Act with the governor, the
14181418 lieutenant governor, and the speaker of the house of
14191419 representatives within the required time.
14201420 (d) All requirements of the constitution and laws of this
14211421 state and the rules and procedures of the legislature with respect
14221422 to the notice, introduction, and passage of this Act are fulfilled
14231423 and accomplished.
14241424 SECTION 4. This Act takes effect immediately if it receives
14251425 a vote of two-thirds of all the members elected to each house, as
14261426 provided by Section 39, Article III, Texas Constitution. If this
14271427 Act does not receive the vote necessary for immediate effect, this
14281428 Act takes effect September 1, 2009.
