5	5	relating to the designation of days, weeks, and months for
6	6	recognition by concurrent resolution of the legislature.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. The heading to Chapter 391, Government Code, is
9	9	amended to read as follows:
10	10	CHAPTER 391. RESOLUTIONS FOR STATE SYMBOLS, [AND] PLACE
11	11	DESIGNATIONS, AND RECOGNITION DAYS, WEEKS, AND MONTHS
12	12	SECTION 2. Section 391.001, Government Code, is amended to
13	13	read as follows:
14	14	Sec. 391.001. EFFECT OF CHAPTER. (a) This chapter governs
15	15	the designation of state symbols, [and] place designations, and
16	16	days, weeks, and months for recognition made by the legislature by
17	17	resolution approved by each house of the legislature.
18	18	(b) This chapter does not affect the designation of:
19	19	(1) a state symbol or a place designation made by:
20	20	(A) [(1)] resolution before September 1, 2001;
21	21	or
22	22	(B) [(2)] statute; or
23	23	(2) a day, week, or month for recognition made by:
24	24	(A) resolution before September 1, 2009; or
25	25	(B) statute.
26	26	SECTION 3. Chapter 391, Government Code, is amended by
27	27	adding Section 391.004 to read as follows:
28	28	Sec. 391.004. DESIGNATING DAYS, WEEKS, OR MONTHS FOR
29	29	RECOGNITION. (a) In this section, "date designation" means the
30	30	special observance authorized by the legislature that annually
31	31	recognizes and honors a culturally or historically significant day,
32	32	week, or month in the state.
33	33	(b) The legislature may assign more than one designation to
34	34	a day, week, or month.
35	35	(c) Before the legislature may designate a day, week, or
36	36	month for recognition, the legislature must be presented with
37	37	information related to the historical or cultural significance of
38	38	the day, week, or month to be recognized by persons supporting the
39	39	designation.
40	40	(d) A designation of a day, week, or month for recognition
41	41	expires on the 10th anniversary of the date the legislature finally
42	42	passes the resolution making the designation. This subsection does
43	43	not prevent the legislature from redesignating a day, week, or
44	44	month for recognition during or after the 10-year period.
45	45	SECTION 4. Sections 391.002(c) and 391.003(f), Government
46	46	Code, are repealed.
47	47	SECTION 5. This Act takes effect immediately if it receives
48	48	a vote of two-thirds of all the members elected to each house, as
49	49	provided by Section 39, Article III, Texas Constitution. If this
50	50	Act does not receive the vote necessary for immediate effect, this
51	51	Act takes effect September 1, 2009.
