| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 3843.207, Special District Local Laws |
|---|
| 12 | 12 | | Code, is amended to read as follows: |
|---|
| 13 | 13 | | Sec. 3843.207. PROPERTY OF CERTAIN UTILITIES OR SERVICE |
|---|
| 14 | 14 | | PROVIDERS EXEMPT FROM ASSESSMENT AND IMPACT FEES. (a) The |
|---|
| 15 | 15 | | district may not impose an impact fee or assessment on the property, |
|---|
| 16 | 16 | | including equipment or facilities, of: |
|---|
| 17 | 17 | | (1) an electric utility as defined by Section 31.002, |
|---|
| 18 | 18 | | Utilities Code; |
|---|
| 19 | 19 | | (2) a gas utility as defined by Section 101.003 or |
|---|
| 20 | 20 | | 121.001, Utilities Code; |
|---|
| 21 | 21 | | (3) a telecommunications provider as defined by |
|---|
| 22 | 22 | | Section 51.002, Utilities Code; [or] |
|---|
| 23 | 23 | | (4) a cable operator as defined by 47 U.S.C. Section |
|---|
| 24 | 24 | | 522, as amended; or |
|---|
| 25 | 25 | | (5) a public radio station. |
|---|
| 26 | 26 | | (b) In this section, "public radio station" means a business |
|---|
| 27 | 27 | | or enterprise that provides radio broadcasting services to the |
|---|
| 28 | 28 | | public and receives a majority of its funding through donations of |
|---|
| 29 | 29 | | money from listeners. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2009. |
